BADWRX 07-07-2002, 02:44 PM On our way home from dinner last night...
Over on McCarthy Blvd in Milpitas...some Milpitas cop decided to nail me for all sorts of things.
No front liscense plate, modified emissions system (Aftermarket intake) and an insufficient exhaust.
Plus he says that I was exhibiting speed, and threatened to take me to jail. I was pretty pissed because he was such a ******. My wife was madder then I was.
So, by the 21st of August, I have to get my car examined by a Smog Ref. BACK TO STOCK SHE GOES FOR A DAY. I am not replacing that uppipe though.
I think that he let me off on speeding and exhibition of speed. Advise me if you know what this means...
There is not boxes checked for correctable of not, and there is no box checked for infraction or misdameanor. Plus there is no court date for the "24004" It just says advise 24004 and all of the boxes are lined out. I do believe that that means that it is a warning. He did not tell me that I was busted for speeding...just made some stupid threats. No radar either...it says 50+ in a 45...plus...he was like 100 feet away. he tried so hard for me to tell him how fast I was going. I was doing 60ish, but I am not gonna tell his fat ass that. I was like, "It reads in kilometers sir...I don't know!":lol:
I am a firm believer that bad things come in threes, so, this should be the last bad thing for awhile:
1. House got broken into.
2. Got into heated argument with wife.
3. Got a mad infraction ticket.
Let me hope anyways..and knock on wood!

This queer was not ex-military...you can tell. He was one of those **** that got beat up in school, and then after school made a vow to himself to, "Get back at all the bullies, and cool people in the world."

That is not service to your country...that is a travisty. Most cops aren't heroes...they are just geeks trying to be cool!

If you really have to go to a smog ref, your not going to get by with the uppipe. A smog ref is not like your corner 76 station.
AWDconvert 07-07-2002, 04:58 PM I've gone to a ref a couple of times, and they are THOROUGH--tough to get anything past them. Granted mine was for an Integ engine in a Civic, but still...

titsataki 07-08-2002, 12:07 AM my guess is that the officer asked him to pop his hood. You can refuse and most likeyl get arrested or at least given a very hard time. The officer will call it in and I am sure they will find some crazy thing to warrant probable cause and they may arrest you and take your car apart and most likely have it towed on a regular tow truck no flat bed. They it would screw you AWD and next try to take them to court blah blah... waist of time in my book.
I would think. You are taking your car back to stock. Putting the stock turbo how much more is to put in the uppipe (it is bolted to the turbo anyways :))
The smog ref I bet will crack open the subaru manuals and check for the first thing -->
ref:hey this little car has 3 cats... Let me verify that. Ok now where is your up-pipe sir?
You : well I am not too sure I thinkit is burried somewhere under the turbo or something.
ref: well Id not have time to check I take it it is ok. I will sign you off and be on your way.
or ref: well let us double check on that. (now here is the catch how far can they take it? do some investigation)

Ps: what does exhibition speeding mean? Like you were showing off by going too fast? Ok I get it.
1) you are speeding --> get ticket moving violation
2) you are speeding while you are racing another car ---> moving violation all kinds of things..
*3) you are speeding to show off by yourself heavier violation than just speeding. I bet it is the same or as bad as racing/speeding (in reality it is a made up thing to nail people harder)
spike 07-08-2002, 12:14 AM A friend of my brother's is a cop in Albany, so I will ask about that, but it doesn't seem right that they can just ask you to pop your hood. I can see bending down and looking at your exhaust, but not inside your hood. But, as mentioned above, I guess they have the ability to really make your life difficult if you don't.

What VC section were you cited under? How did the bacon ascertain that your exhaust was insufficient and under what standards?

I believe an officer does not need probable cause in a traffic stop to search your vehicle. Unfortunately I don't remember the specifics about it and am not even sure what the details are from a legal standpoint. I know there's an officer that frequents this forum but I forget his name. Perhaps if you're reading this you could fill us in on the details.

I have a HKS carbon-ti catback exhaust and I got a ticket for unlawful exhaust. Please help me. Should I just pay the ticket or take it to court.

is it a fix it? did you get the little note in the mail? Can you go to court or clear the citation by paying? Maybe you can call and find out what you need to do.
Did you ask the officer why he considered the exchaust unlawful? Too loud?
Keep in mind that they keep those things vague on purpose so the court/judge can go either way (dismiss or nail you).

Berman 07-09-2002, 12:44 PM The cop was trying to get me for speeding but I saw him standing outside of his car. He just didn't like the way the car sound, I think. He told me that anything that I put on my car that isn't from the factory then it is illegal. I told him that catbacks are street legal but he disagree.

Second off, Cops are jerks. They have to be, the problem is many dont know when to turn it off. There are enough in my family for me to know :rolleyes: .

Actually, technically they either need a warrant or "probable cause" to search your vehicle.
However, they can do all of the field sobriety tests and even blood and pee sample testing on YOU since you signed the voluntary consent waiver when you signed up for a drivers license.
The unfortunate reality is that in a lot of jursidictions they can use your denial of allowing a search in their determination of "probable cause" and there you are......
Yeah, some cops can be a real PITA.
