View Full Version : 1st gear failure - going after SOA

My friend and client bought his dream car last year only to end up parking it since SOA denied a fair warranty claim for a failed first gear (stripped teeth). SOA claims owner abuse. The car has only 3600 miles and was never abused.

We've tried everything to get SOA to authorize warranty work on the car and have been left with no choice but to sue them. Anybody else have similar "war stories" they want to tell? We're in California and have a suit pending and could sure use the help to show a "pattern and practice" of SOA in denying warranty claims. Our goal is solely to get them to change the way they handle warranty claims, and of course, to fix his car!

I already have 47 VINs of same issue and same denial by SOA, maybe one is yours?

On the off chance that you have not thought of this.

If 1st failed through no user abuse. Chnaces are that there is a manufacturing defect. If you have the gear and the teeth have a metalurical analysis done on them. If they were improperly manufactured and you can show you should have a much easier case. You might also beable to get an engineer to estimate what loads the gears should be able to take and compare it with what they might reasonalby see in the car.
