View Full Version : Speeding ticket dismissal question (WRX is made by Mitsu?)in
TylerTheToaster 04-19-2004, 04:45 PM Well the V1 doesn't really work when your sleepy and its late at night not paying attention so recieved a nice little 83mph in a 65mph on I-35 going through Itasca. I'm leaning towards fighting it even though I'm in Austin because: I don't want to pay $220 for a ticket and the she-cop wrote my date of birth as 3-18-03 (not 83) and the make of my Rex as a Mitsu, thank you debadging.
I've been trying to find out if these mistakes are grounds for dismissal, other than the old calibration argument and the fact I was the only one out on the road and driving safely.
Anyone who wants to help out I'd greatly appreciate it.

Aegon 04-19-2004, 04:51 PM If it is late, you are sleepy, and you aren't paying attention maybe you should pull over. I don't want to be a jerk, but this sounds like a dangerous situation to begin with.

I'm sure if you were tired enough you would have pulled over, the dude above needs to check his own morals before attacking yours.

Just get a lawyer. I got a 80 in a 50 up here in Ft Worth. $37 flat fee to the lawyer, and it magically went away. No fine, no record, it never happened. God bless America!
Sure you could fight it yourself, but it was worth the 37 bucks to me not to have to deal with going to court (and the court fees and then you maybe having to pay it anyway). All I did was go to the lawyer's office, give him the ticket, then sit on my ass.
Gundoo 04-19-2004, 05:22 PM 37 dollars seems extraordinarily low to me. Most people I talk to say the lawyer cost them what the ticket would have been (usually $$$) but at least it doesn't go on their record. Typo?
TylerTheToaster 04-19-2004, 06:18 PM Don't worry I wasn't so tired that I was putting anyone in danger, just worn out from the day and not paying attention to the beeping red lights.
I wasn't going to bother with a lawyer but after thinking about it I guess it wouldn't hurt to call around and get some prices considering gas money alone to get there and back for a court would be in the same ballpark.
(P.S. Gotta love having a birthday right during spring break when no one is around to celebrate.)

But I think you still have to go to court w/ jury trial, etc.
Can you settle this by mail like the one in NZ?
You have to tell the judge and jury (if it's in court) that the officer can't even recognize the car and write down your DOB correctly.
Then how is she competent of becoming an traffic officer.
She might have pulled over a wrong car?
Cause what she saw was a Mitsubishi and WRX is a Subaru.
I don't about your the error of writting down your DOB.

Do you by chance know what the lawyer did?
I am curious..
Cause last time I called these type of lawyers they said $70.
And I asked so what are you going to do?
The lady replied:
Probation w/ the fine you pay in court.
Doohh.. I could do that myself.

the judge will not let you present your case(incorrect info on ticket) unless you know whn it is your turn to speak.
i tried this once and ended up paying the ticket.
now i have learned.....get an attny and let him do the talking tht he is paid to do.
get an attny=100% chance of ticket not being on your record
do it your self= poss chance to get dismissed/100% of court costs
poss having ticket on your record
you make the call.

sayaben 04-20-2004, 02:16 AM get a lawyer. i tried to fight a tickett where they wrote my eclipse down as a silver ford mustang. they convicted me simply because "i had the tickett, so i was the driver, so i was guilty"
notyet227 04-20-2004, 08:50 AM it wont matter if they messed up somethin like that on the ticket. It has to be somethin more than just the make or model mistake. Who did you get pulled over by. I work at DPS maybe i can do somethin. lol

Torch 04-20-2004, 02:15 PM I usually hire an attorney for about $35-$40 and let them deal with it. In about a year or so the attorney sends me a letter letting me know I received deferred adjudication and I have to pay between $80-$100 in a fine. Which is less than the ticket would have cost and it is not on my record. All I have to do is not drive fast for a few months in the county I received the ticket and all is good.
I do not have the patience to go downtown to court and put up with all those people. I would end up getting myself in more trouble than I started with.
Also, as a side note I received a ticket going through Austin and they do not have the same setup as other counties. For some reason I could not just pay a small fee I had to pay an attorney by the hour to go fight my ticket. One attorney told me it would be $350 for just his fee. Needless to say I took defensive driving.

TylerTheToaster 04-20-2004, 03:34 PM The problem with deferred ajudication in this case is that it just adds $50 to the overall cost of the ticket. So its $170+$50=not good for business. I'm calling a guy in Hillsboro and seeing what he'll charge me.
