I called about a week after 9/08/04 wondering where it was and gave you my info then. You said you were having troubles with the software and said to wait another week b/c you said the delivered date probably meant the ship date. Then you were moving and the hurricane happened. Ok, I understand that, but now it's been about 2-3 weeks after the hurricane and still nothing.

I also sent you email using your website and giving you my info there as well. Still nothing.

As a I recall someone posted about not getting anything for like 4 months, I'm like half way there. The whole reason why I bought from you was that people said you were good even my friends say so. But from here it doesn't seem like your living up to that reputation. If I don't hear from you by the end of this week, I'll have to go through my charge card company to get my money back and look else where.

I believe I've been pretty patient on this, but I guess even some of the patient ones run out of patience eventually.

To tell the truth, I am kind of nervous about that whole rebate deal, never heard of it before and I am not feeling too comfortable with the "INSTANT" part of it. boost_away - You have a good reason to be nervous, because I'm still waiting for my Stage 1 kit and it's been 2 months already. Look at the above posts of mine. Personally, I think he should fulfill other people's orders first before trying to start another "deal". I contacted him about this and tried to get a tracking number, but nothing yet. He has until the end of this Friday to get me a tracking number that proves my stuff is on the way or I'll be calling the card company. I think I've been pretty flexible with this, because he was moving and the hurricane thing. But this is it, I can't wait any longer.

Plus, correct me if I'm wrong, but he's suppose to sell in stock items. Even if my kit was in stock and got shipped out, I'm not responsible for lost items. btw guys check out the Vendor reviews particularly the "What would you do..." and Ninos.

Seems to me to be a misunderstanding about the rebate. From reading it it seems to me that you guys should have subtracted the money yourselves and not paid it in the first place. So if one clutch is $500 with a $150 rebate you just sent him $350 and there is your instant rebate. I seriously doubt paypal has an automated rebate function.
But it sounds like he sold a bunch of stuff not in stock. I have only heard good things about nino before too, this is surprising.

Here is what he sent me in response to my PayPal complaint via email:

"It would have been nice to know you wanted the tracking # on the payment so I could have sent it rather than charging me back without warning. It'll be interesting when I call for it tomm and the kit is out for delivery despite me now not having teh $ in my acct."

Calling for the kit? Seems to me like he is indeed selling something he didnt have in stock. Not only that I asked him numerous times for a tracking #, and never received it. I hope you right all these wrongs.

Contact/Investigastion attempts are as follows:

1. Tried calling 732-557-0491 as listed on your website.
2. Got a message saying the number had been changed and was now 732-684-9825.
3. Called the 9825 number only to talk to a guy saying he had been getting all kinds of calls about car parts since he got the number a few days ago from Nextel.
4. Went on PayPal and got the same # as on the website.
5. Noticed your AOL email address was Jetfan8178@aol.com which meant to me you must have AIM using the same SN.
6. No logons from that SN over about a 4 day span.
Lets move to RSClub where I went to vendor reviews. Two reviews had been left 3 days apart from separate people. Both with extremely negative feedback. These being on 11-02 and 11-05 One of the people being a local guy who to the best of my recollection was always very patient about parts coming from overseas, so I figure the same would apply domestically.
7. You had logged onto Nasioc, and posted things about your tranny you were trying to sell on 11/5, 11/10, and 11/11 not to mention in the thread where you were selling the stoptech brake kits on 11/07 and 11/08.
8. PM's had been sent numerous times between 11/4 and now, none responded to until a few days ago.
9. The huge part out of a $4k tranny, $2k brakes, and $1.5k turbo setup, the "Craziest Clutch deals ever!! Ill beat my competition or its yours FREE!!" selling point, and non response to all contact attempts set off an alarm to me of a possible "get cash quick, worry about problems later scheme."
10. Not sure what to do I left an ultimatum via PM. Tracking #, product, or contact me before I take action with PayPal to hopefully lock your account with enough funds still in it to get a refund from them if necessary.
11. I receive responses saying you have to call and track it and such all pointing to it being "drop shipped," which is afterall a violation of Nasioc Vendor Classifieds.
12. Your PayPal account is locked, and finally I start to see action about whats going on from you. It seemed as if once your funds in PayPal had been locked there was suddenly an interest in my situation.
13. Receive emails saying your account is locked, and you cant refund or receive funds. I have had my account locked before, and there was an option to refund the money to instantly resolve the situation.
14. I said I would cancel my dispute which would unlock your account to my understanding. But there was a holdup. Your checking account in FL had not been confirmed and thusly PayPal maintained the lock on your account.
15. Resolutions were suggested by me about sending me a MO, and just keeping the PayPal money since I had ended the dispute and PayPal could not refund the money to me on their own anymore.
16. Then to add insult to injury there was supposedly a clutch that had been shipped to me, but you said you were going to stop it intransit and wait it out for PayPal to refund my money.
17. Now today you get on it, say you are having a clutch shipped overnight, and would send a $25 refund to me for all the trouble. All of which are very nice gestures, but simple communication, and straight forward information would have kept all this from happening. As I asked before please send the tracking # via PM here on NASIOC, so I can be home to receive the package. Understood about the refund button pushing situation, I just never had the same problem and to the best of my knowledge that was one of the purposes of the locking of an account.

The email basically says, that you said you contacted Exedy and they can't find the info. And you don't know why I never got it. Me neither. You offered to send me another. I said yes.
