I am a twenty-nine year old Account Manager in Long Island, NY, about fifteen miles from New York City. I have experienced similar transmission related problems to many of those spoken of in the forums, only to be told by SOA that they are not covered under warranty. The reason they gave is that the problems are a result of aggressive driving. The best part of it is that I didn't do any performance work to the car and didn't raise it. Performance work and aggressive driving are two excuses they are using to avoid paying for installing a weak transmission in a vehicle that they market as a street legal racecar. I know in a lot of cases the performance work that is done does not affect the transmission at all. I believe it is time for us to band together. A company like Subaru Of America Inc. is far too large to fight alone. However, in numbers we can accomplish a lot. I plan to call Channel Seven news in New York. They have a particular program called "Seven On Your Side " that deals with consumer issues like this everyday. I am looking for some way to contact those who have had similar issues to mine and provide them with a way to contact me.

A good friend of mine who is a lawyer has been helping me out and feels that given the amount of similar cases, we have cause for a class action suit against Subaru. I have already researched this and spoken with officials at Civil Court in New York. I am looking to speak with anyone who has had similar problems with Subaru owning up to their part of the bargain. Umm, you don't have much experience with class action lawsuits do you? You need a bunch of people with the exact same problem that Subaru should be fixing, not just a bunch of people unhappy about SOA not doing warrenty work. Thats what individual lawsuits are for (small claims court).

Bring a dickhead dealer or SOA to court, and they will just settle with you to avoid having to deal witha lawsuit.

One class action suit against SOA went to appeals court in California and was decided in SOA's favor, based largely on the standard mentioned by mcowger. That case is known as Osborne v. Subaru of America, Inc. (http://jon.in.ct.home.att.net/Osborne_v_SoA.html) and is widely cited. gregg (and his lawyer) should read it.

Didn't someone in California just try this recently and the judge found against the WRX driver and found him liable for Subaru's court cost or some high number for lawyers fees or something?
