I know like everyone with a 5speed wrx has had problems with gear grinding or blowing up a 2nd gear, I know i have twice
Is it possible that we could all get some lawyers together and go after subaru, I'm trying to get them under the lemon law right now

1) Its suit, not suite.
2) You don't do class action suits under lemon laws, you do them under negligence and fraud laws.
3) You have to prove to a class action law firm that they will make at least $5 million on this, as thats what it costs them for a lawsuit of this size.
4) Most people have not experienced the problem with 2nd gear blowing up. For a successful suit, you have to show that it affected the vast majority of the owners of that product. In this case, it has effected performance minded folks and the people who mod the car, which is probably less than 20% of total owners.

Not gonna happen. Sorry.

It did happen, and failed. Do a search here, the suit was filed and failed in 2003 or 2004 in San Jose CA.

My first gear grinds at a dead stop sometimes on my completely stock car. It has done so since about 20K miles. I don't see this mildly annoying quirk as anything to file a law suit over, though...

As far as his post, I don't think he was giving you any ****. He was either helping you out on your spelling or explaining how things work. Just because he didn't sugarcoat it doesn't mean he wasn't trying to help. And no, I don't think you have a chance at a lawsuit. Aside from the fact that you've modded and raced your car, it sounds like your thought process on this whole thing sucks. It's not like you've got a certain number of drag races or launches that will be safely handled by your tranny before it gets damaged. Even one can damage your transmission because it's not designed for it. Plus you've got a modified car (ie more horsepower than Subaru designed it with) so what's your standing legally? How exactly are you going to go after Subaru with a modded car? Suck it up, buy a reinforced gearset (see Kaaz or GimmeGears) and stow it about lawsuits.

No, it's not. It's your fault. Learn to drive and take some accountability. It's not Subarus job to pay for your idiocy. Two transmissions and one block should be a sign that it's not the car that sucks but the driver.

Getting back at Subaru is a lost cause...the tranny is weak, yes but the truth is if you treat it right it will hold strong for w/ serious hp. I have seen 11 sec wrx's on the stock tranny. Also for most of us it is our first awd car and you have to take the extra strain it puts on the drivetrain into consideration.

Exactly.

JWerty1, you claim you never had this problem on your previous cars. Which of those were AWD and had 280+ ft-lbs of torque?

I have one of those fluke trannys I guess. About to hit 90k less than easy, but not outright abusive, miles.

My car already has a grind going into first gear from a stop, and it's unmodded and driven nicely on the highway everyday. Dealer couldn't fix it?? Oh well, when it breaks I'll just get a JDM 5mt.

There are 2 seperate, but common, tranny issues. Gears breaking and synchros not working. Gears breaking is usually people shredding second gear. This mostly happens with drag racing or increased power although some people may have experienced it under normal circumstances. I feel sorry for those people b/c no one will ever believe them.

The other more common problem, synchros sucking, is usually grinding into 1st and 4th gear - or being almost impossible to get into 1st gear w/o double clutching or coming to a complete stop and going into 2nd then 1st. This has *absolutely nothing* to do with increased power levels or drag racing. I think this is just a crappy design and a serious weak point (or outright flaw) in the tranny design. It really sucks.

Yerp, im getting a new first gear synchro next week from the dealer. I was also told my 03 WRX has a super stiff clutch way beyond normal and that will be getting fixed as well because it can lead to thrust bearing issues or something.

I think its mostly driver related. Treat it good and it will treat you good.

That wasn't class action, and wasn't under a lemon law.

I didn't give you **** about it. If you are interested in something, you ask a question, which you did. presumably you are interested enough to possibly persue it. Hence, I informaed you of some basic issues (like spelling, laws, etc) that you would face.

I didn't call you stupid (I doubt you are), a l4m3r, n00b, or anything else. I mearly made some comments. Whats the problem?
