View Full Version : Military folks buying handguns
OrionAK 08-25-2005, 11:29 PM Question:
Friend in the Marines is currently in North or South Carolina. He's from here. He called today asking what the hoops were to buy a handgun up here (he's been gone for several years and wasn't of legal age before he left). I explained the situation to him--many of you probably know yourselves: Turn 21, go to store, fill out sheet where you answer "YES" once and "NO" a hundred times, hand it to the dealer, he makes a phone call (let's say successfully), you pay, you walk out 10 minutes later with a gun.
He said in Whichever Carolina, because he was military, he had to get a note from his direct supervisor/commander, the base commander, the local police department and then go through a whole lot more stuff that I don't really remember.
My question is this: Is this common for all Military folks, regardless of state, or is this just the Carolina law? Do the men and women in the Armed Forces have these hoops to jump through everywhere? If so, not cool.
Bonus Question: What is involved in a private citizen selling a gun to another private citizen. In his area it's the same as above. I've never sold any of my guns, so I don't know. Anyone here know? I was under the impression from an officer friend that you just sold it, didn't have to fill out any paperwork. This doesn't make a whole lot of sense, what with background checks and serial numbers and the like.
thetomstudley 08-26-2005, 12:27 AM Im in the Army, and although i dont own a handgun, I know that up here, all you really have to do is register the weapon with the proper autorities here on the base (just bring them the papers & stuff) most uits here on ft rich have arms rooms that you can store your weapon in. I like how on the PX on the air force base has a gun store inside with mostly any weapon you could want... Alaska rules!
Glad I could help,

The laws vary from state to state. As far as I know, most states require you to be a resident to purchase handguns. Military stationed in state is an exception, in the states I've been in I just had to show orders to purchase.
fc6666 08-26-2005, 01:57 AM I bought a Sig 226 in KS at a gun store, one ATF paper to fill out, showed my orders and mil id, walked out with it the same day....With ammo
If your a single soldier it goes in your units arms room or the PMO arms room, married ok to keep in quarters. You still have to register it with the PMO, and give your commander 24hrs notice to take it out of the arms room.
Spitfyre02 08-26-2005, 02:07 AM Usually a copy of the his orders and an ID. Thats all I needed but I was also buying on base at our BX.
OrionAK 08-26-2005, 02:21 AM Thanks for all the quick answers, everyone!
Anyone wanna chime in on the personal buy/sell portion? :)
Eby--Quite a few states don't require residency as long as you're a US citizen. Oddly enough, I THINK Wal*Mart has a map showing the cooperation of that fact per state. The only ones I can swear to are AK and TX from personal experience, though! :)

Alaska: State law restricts juveniles under 16 from possessing any firearm without parental permission or authorized supervision. But kids age 16 or 17 can possess handguns or even assault weapons without their parents permission. Also see: Juvenile Sales.
JUVENILE SALE
Is it illegal to sell guns to kids? Yes
Alaska: State law restricts selling or giving firearms to juveniles under 18, except for supervised loans of firearms or for limited lawful activities (such as hunting). Also see: Juvenile Possession.
SECONDARY SALES
Are background checks required on 'private' gun sales? No
Alaska: No state requirement that criminal background checks be done on people buying firearms at gun shows, swap meets or through newspaper or internet advertisements. Criminal background checks are only required if the buyer goes to a federally-licensed gun store - all other sales are not subject to the background check.

Wonder if this means just handing it over is fine, or if you have to record ownership? Thanks for the website, I'll check it out after work!

Maddog--I made that for a forum for people that were comparing "weapons". I couldn't help it, they were getting carried away.
Good call on the Blastech, Winslow. I think you're the second person to name that thing...I had to look it up in a friend's RPG books! :D
Tribal--locked up. Those were the things I had in an apartment I was in at the time (just went shooting not too long before it). I keep all rifles and many pistols in a gun safe--these just happened to be available for the photo shoot!
