Well someone should welcome him to the internet. :)

Once a photo goes on the net you can kiss it's 'copyright' goodbye. Only way to 'protect' it would be to...paint his name/logo or something across it. Even then a little photoshopping and it's fixed.

Now if it was posted on a major car website and/or magazine then that's another deal.

I wonder why he doesn't like it?

I'd love for 1/2 the Subaru world to be gawking at my car.:)

Copyright is alive and well on the internet. Somone owns the picture. It DOES NOT give you the right to re-post it.

If someone says, here, look at this CD of Microsoft Office, does that give you the right to install it on your machine? :) Or better yet, give you a link where you can download it for free... copyright?

Same rules apply. Heck, the justice dept just upheld a law for freelancers that they need to be paid for thier work on the net (digital archives), even though it was never in the contract 10 years ago to cover duplication via computer. Has something to do with copyright on the web there. It's a new medium still, but laws are laws.

I feel the owner of the pic has every right to try and dissuade unauthroized duplication of the pic(s) without permission, absolutely.

Yeah, but it still happens all the time! That's how the internet works. Like it or not.

Dave.

p.s. I like your car, Xsara. The Morettes (?) look good. So do your P1s. Did you get that stuff in Ottawa?

Dave99

Xsara, did you get your lights and P1 wheels in Ottawa? They look good. Wing looks good, too.

Dave.

Looks sweet, except for the headlight treatment. Sorry, not fond of the cover ups. The new style grew on me to the pont it looks good.

Can anyone photoshop those back to normal? Maybe put it in blue?

Dave,
Did you read the thread? It's not Xsara's car. Even if the image wasn't copyrighted, if the guy asks that it not be posted, why do people continue posting it? (...I know the answer....:( )

Wheels
08-23-2001, 08:28 AM
They like to continue to post so they can see the demise of a dam good site. And spoil everyone else's time. People should respect other peoples wants and rights. Would some of you like it if I found a picture of you and altered it with the intent to make fun of you and posted it all over the web.

Takes years to build up respect and a following. And yet people on here can some how blow it in minutes.

People go to alot of trouble to bring you a site that you can all enjoy. DONT SCREW WITH IT!!!

HOLY CRAP!

I didn't read the drama before I posted my last comments. I'm more than a little baffled. THe last post wasn't my normal jackass sarcasm.

I REALLY liked the look of that car. In fact, think it's the best looking WRX I've seen, so far. I was thinking I'd do nearly the same thing, but maybe not the headlights. And I'm real partial to blue. Too much speedvision viewing. I hadn't realized I was walking into a battle zone.

HEYA DAVE T_S! Sorry I liked your car so much I was thinking of spending $$ to mimic it. I suppose that "Imitation is the ultimate form of flattery" saying isn't true after all. Hmm..?

BTW, "ALL STATEMENTS ABOVE COPYRIGHT 2001 THE STREETMAN and remain property of the copyrightholder. Any editing, alteration or modification of the original statement is strictly forbidden."

Ahhhh, feel better no that I'm back to be a sarcastic dumbass.

Wheels- WAAAAA Why do anything to your car if you don't want people to look at it? Get over it. You may want to hide in a cave somewhere so no one can see your bada$$ car. I sent the picture to about 4 people and they loved it. Does that not make you feel good? If not you need to stay off the net.
JC- Wrong.

Umm Its not my car. I don`t live in England and I guess you never read the other thread did you?

Thats cool!

If mine looked like that and people colored the car pink to match the house then I would be kind of annoyed also.

I remember the first thread asking for paintshop guys to paint the car the same color has the house.

Before you jump know the facts else it could sometimes bite you in the a$$

Hiho,
That was pretty harsh and ignorant. If the guy doesn't pics of his car spread around, what's it to you?
Why do anything to your car if you don't want people to look at?
Ummmm, for yourself?

HIHO

Wheels- Sorry I was just going by the color of your car. Yes I read the posts. The way you were crying I just thought it was yours.
Subed- Yeah right! Don't post it on the WEB!!! You do know about the web right. People steal stuff? If he did the mods for himself then why take a pic and post it? Why? You explain it to me.

Wheels
08-23-2001, 10:14 AM
The original color is a blue black not red and not pink.

And for the record I only cry when I get told I've been abusive to my babes.

SubEd

Ok. I understand now. A guy posts a pic to a newsgroup, then asks others not to repost it. But it's okay to do so because this is the internet.

Maybe he doesn't want it stolen, I don't know. Whatever his reasoning, simply because you can steal it doesn't make it right.

Copy it like crazy, Hiho, I see where you're coming from now.

Wheels
08-23-2001, 10:18 AM
Because some idiot took his blue car and changed the color to of that of his house.

I'm sure if someone had of wanted a pink car they would have painted it pink. And pinks noted as a girl color or a way in with to insinuate someone is of a homeosexual nature. Especially in the UK.

But end of my disscusion on this topic.

HIHO
08-23-2001, 10:21 AM
Subed- When I copied it I did not know about the owners problem with it. THAT is the problem with the internet. Someone will steal it and post it and someone will copy. That person won't know the owner will get pissed. Passed around from person to person forever and ever. That is the Internet. So don't post it if you don't want the world to see it. It might not be right but thats the way it is.

Debating copyrights on the Internet has been debated over and over, not just in Dave T S 's case. In all the dealings I have seen, you had to prove you did all you could to prevent it from being copied/modified (watermark. etc) and mention that it is a copyrighted item right when you notice it (not joke around about it then state its copyrighted). This case was a joke from the start, which is why people continued it for so long, they really couldn't believe this guy was fighting for his "copyrighted" pictures.

Requesting someone stop posting because you would rather your pictures not be used in such fashion is one item. If he took the calm approach of asking for them to not be used, I doubt much, if anything, would of come from it.

The Internet is NOT "public domain" but it IS impossible to enforce, and it IS "free reign". Anything you post on the Internet has the possibility to be downloaded and used for any number of uses, and there shouldn't be anyone to think otherwise.

Now with that said, the picture is nice. I really like the red color and the lights look nice, but I still wish the crack between the lights and the hood could disappear. On a black WRX with these lights, you barely see that crack, and it looks SO much better, IMO.

First off I'd like to say that Dave T-S has 2 of the nicest wrx's around! Lucky guy!

What I don't understand is the dramatic shift in his attitude. If you read through the threads, in all of them he's going along all nice, answering questions and such and then all of a sudden the copyright infringment message. I just don't get it.

while people may debate the copyright laws and thier enforcement on the net, it does remain illegal to, in any fashion, reproduce copyrighted material in any fashion. Can they stop this..nope, but if you do it, and the pictures were copyrighted, and you live in the us and your isp is us based them be sure that the person can and may find out who you are, and sue the **** out of you, not to mention the federal copyright charges that the police will file.
That said, i think dave got pissed once people started to ,make fun of his house color, and alter his car with woman and stuff, perhaps his wife(who uses the other really nice wrx) didn't appreciate it and now he has to deal with that thanks to a bunch of retards who need to do stuff like that. even though it may be legal gray area right now, rest assured it will not remain this way for a long time,(napster) and why not just respect the guys wishes and not use his pics. There are plenty more pics out there whose owners don't care what you do, that would be just plain old nice, no need to be dicks and do exactly what he asked not to be done.

Section 108(d) 1976 U.S. Copyright Act -permits reproductions of articles, or contributions to collections, or small parts of larger works for a patron’s private study, scholarship, or research.

sections 108 b through l were made to allow libraries use of "information"
this forum is basically a private study by the i-club

i could see if morrette used the image, but thats not whats happening here

I'm fairly familiar to copyright law as it applies to design and photography. And even though I can sympathise with Dave T-S about the whole thing, I can assure you that the picture posted is not copyrightabe. Just because you take a picture simply does not mean it's copyrighted, it has to have individual or unique artistic value that sets it apart. This may seem harsh to the little man, but I've specifically read the law and commentary on it. If I can find it on my bookshelf again, I would post it and end the argument for everyone.

Common courtesy, however, is not governed by law. I think all Dave wanted was a little respect. Like he said, commercial websites had pirated the picture for their own gain and people had manipulated/mutilated it a whole bunch also. That is when he got upset and tried to pull it. Unfortunately for him, it's pretty much out of his control now.

I love the way I-club moderators are so afraid of this guy. Never mind standing up for free speech, your rights or anything like that. Let's all just cower in a hole.

This guy posted a picture of his car in a public forum and asked peoples opinions. He only got mad when he got a response other than, "that's the cooloest car ever and you are cool too dude !!". You can't use copyright to say, "Everyone who likes my work can copy it freely, but those who don't are going to be sued !"

As far as this US based IP business. The dude lives in England !! Come on people, wake up. What do you think, He is going to have you extradited on a copyright charge, good lord.

If Mattell can't stop you from exhibiting Barbie in sexually suggestive positions, Dave TS can't stop you from painting his stupid car pink !

So please I-club moderators, display some cajones, stand by the important laws, you know the ones in the constitution, before bowing to trivial corporate ones.
