It isn't quite this simple. If you disable the EGR you will eventually get a CEL even if the solenoid remains in place. The ECU checks to see that the EGR is functioning (not just the solenoid, it looks for changes in the 02 sensor when EGR is applied). There won't be an easy way around this without the ability to reprogram the ECU to ignore the EGR.
Also with the EGR removed you may experience some detonation. Since the EGR works to limit NOx emissions by lowering combustion temperatures, it also reduces the tendency for the engine to detonate. When the engine is designed and the ECU maps written, the presence of the EGR is taken into account.
