There are actually internal clamps that wrap the pipe and sort of hold the bolted together heat shield floating around the pipe. Its these internal clamps that break eventually allowing the outer shield to fail to float around the pipe and actually hit the pipe.

With the above precautions and not parking in tall dry grass if the exhaust is hot, youre good to go.
