hey guys,
so i got a ticket for 90 mph in bucket rental car, in the marin county. somewhere on the ticket reminder, it says that, "traffic school does not apply for speed in excess of 80 mph". this is my first ticket, and i plan on paying the bail and doing traffic school... if possible. is it true that i cant do traffic school because i went over 80? that would consequently mean that my next action would be to pay the fine, and keep the point. thanks doug |

I got a ticket about 2 years ago going 85, I got written up for 80+. I was able to go to traffic school and avoid the point. My buddy on the other hand got nailed going 90+, he couldn't go to traffic school because it was 89+. So unless the rules changed, as far as I know it is 89+ and you can't go to school.

If you can, appear in court. Plead guilty, ask for traffic school. Unless you get a hard core judge, or one who is having a bad day, he'll probably knock down the charge, saving you some cash and you can take traffic school

I got a 90+ ticket in SAC county back in March and was able to do the traffic school routine.

It is up to the Judge whether or not you can go to traffic school, but going "by the book" you are not eligable if you have taken traffic school in the last 18 months, if you were going 15 or more over the posted speed limit, or if you were going over 80.
So yeah, you probably will need to make an appearence in court if you are going to have any chance of getting to use traffic school to keep the point off. By the way, that only applies to the points that get reported to the insurance company- it does not take it off the point total that the state uses to determine habitual offenders and that the Judge has access to next time you get busted. 4 points in a year means a 6 month suspension so try not to get caught again- for a while anyway! |
