Default crap..hitted some one in the back this morning...

I bumped in to a car at a stop sign this morning.. after that we exchange phone num, insruance info and such informantion.. her car have no visible damage.. where mine have some chiped paint here and there.


I asked if she is ok, she said the car is totaly fine but her neck is a little "Numb.." so she is not sure..


now i am at work.. wondering what i should do after work..
report to the police? call my insurance company? or.. who cares no need to worry?

thx for any advice in advance.

Sorry, but you always have to worry. She could deciide 18 months from now that she's had neck trouble since the accident and sue for injury.
BUT, don't tell anyone. No immediate significant damage or injury so no reporting is required. DO NOT contact your insurance company. It has no benefit, and they might mark your record.
Given that anything can happen in the future, sit down tonight and write down a description of the accident and what was said and done at the accident scene, how she seemed etc, etc. File it away for use if an action arises in the future. All you can do, but it can really help. Prior advice from my next door neighbour who happens to be a judge.

if that is some advise form a JUDGE, i wil definately listen to it.

my previouse concern is.. if she did want to sue me later on for fun.. shouldn't i be better off pay a visit to the cops and file a report NOW before things get out of hand?

some buddies of mine tell me not to worry about it, since she did not call the cops and she did not care to find vitness.. so even if she have bad bad beck due to me.. it could be another accident she got After mine that hurt her... since no body can prove nothing.. beside me hit her that morning and i gave her my info.


.. so i guess. i don need to report to insurance or cops after work today..

i think she has only 24hrs to file a police report. if she doesn't within that time period, sucks to be her. im not 100% positive though, so you might want to ask around about that.

Do you remember if her headrest was adjusted properly? If she does give you problems, improperly used safety devices on her part may reduce liability.

There were a lot of brocures about this at my insurance company because of the amount of injury claims for whiplash, which would have been prevented with a properly adjusted headrest.

Just for fun, look as other vehicles as you drive or walk by, and you wioll notice that almost none are adjusted properly.

--from some manual, I forget where---The top of the drivers ear should be as close to the centre of the headrest as possible.

is kind of too late to think about the head rest now...i totally don remember..

talked to couple freinds... one of tham actualy was in the same boat as me.. and got sue for 10K or something..

insurance took care of it.. and of caz, his rate went high high..

the head rest defence will not hold up... its her word against yours. if she files a report iirc within 48 hours and does the shady doctor fake neck hurting thing your screwed... well.. not you but your insurance.

Keep quiet. DO not contact her. Let her go on beliveing that she has time. SHe does not. If she does not see a doctor, she cannot make a medical claim in any way, shape of form. The fact that she already claimed to have neck pain is not a good sign for you. But you may argue that must have been a "pre-existing" condition b/c whiplash takes time to show symptoms - period. The time limit for seeking property damage in AB is 24 months! Yeah that shocked me too. But at least in court common sense does preside. Most judges won't even hear a case unless a "reasonable" timeline for claim is followed up w/ proper documentation.

BTW, the headrest defence only in AB if your Ins. Co. investigates it. See, in AB the province has made very public efforts to make drivers aware of the dangers of poor headrest position. I've seen many cases thrown out b/c the injured person had "no reaon not to know better". That the AB way.
