Default Jury awards $5 million to family of boy who choked on hot dog

Juan Loera's family, represented by Kenneth J. Allen & Associates of Valparaiso, claimed personnel at Hailmann Elementary School in LaPorte attempted to help the boy, but without training for such emergencies the attempts were unsuccessful and the boy died the next day.

It's bad that the child died, but why does school have to pay for it. Are they gonna teach all of the school staff to do CPR?

CPR is not hard to learn. You would think it would be a prerequisite for every teacher and childcare worker.

yes, or at least enough of them to cover medical emergencies like this.

in this case, i'd say the child was the biggest loser, followed by his family. then maybe the insurance company.

If someone takes a job or is appointed to watching children, they should have basic first aid/CPR training. As pointed out above, there should at least be a "first response team" at the school.

Attention: ****ing idiot ****wit n00b posters - if the lawsuit was frivolous, then it wouldn't have ****ING WON. School staff should be trained in CPR and the Heimlich maneuver. It's not ****ing rocket science.

I'm just guessing but most likely the school had a policy that everyone take CPR but they just blew it off and ignored it. I would also suspect that they were not the first ones to complain about this.

I agree with the Jury the school was clearly negligent.

In cases of wrongful death there is unlimited damages present.

This guy is either new to civil cases or supremely sarcastic.
