Default Towed away. Wrongfully?

I was parked in Ybor city in tampa today. I always park there every time I'm in ybor. Today I was towed away from a "section" of the entire lot.

Now this "section" was not specified as a tow away zone. The entire rectangular lot is not sectioned off. There is a tow away zone on a fence that I did not cross. I parked in the same "zone" as the rest of the cars, yet I was parked in a tow away zone?

Here is a picture to further depict my parking



I was parked before the tow away sign, in the same "zone" as the rest of the cars. As you can see, there were other cars in the tow away zone marked by the "la union marti maceo".

I specifically asked them about the other cars with me in that rectangle, and the tow company said they were fine. Yet my car, in the same "Zone" as the rest of the fine cars, was towed.


Am I stupid to call my attorney about this?

well it seems that your tow away sign you drew is about as vague as the one that was where you parked. Call your attorney.

call em especially if they didnt' tow you on a flat bed, had a friend w/ an awd car who was towed by one of those trucks that drags the rear wheels, tow company had to replace all his diffs or somthin lol

If it's their property, they can tow anyone on it.

Did you have some legitimate business with someone bordering this lot?

It was approximately 3 in the morning. I understand that someone owning the property can come in and have my car towed away, but this was one of those situations where the driver comes, assesses whos in the zone, and tows it away himself.

Oh I made sure they towed it correctly, haha. I was bored one day and searched "towed away destroyed" and a lot of horror stories of destroyed trannies came up. It was interesting.

it all comes down to money...the guy driving the wrecker making a buck and the property owner getting a cut...

it sucks, but around here the tow guys are ruthless and seem to come out of nowhere to tow from lots around the bars on the beachside strip here in daytona

I just came back from retrieving my car. They said there was a property line that I had crossed.

There was nothing differentiating between the public and private lot. It was all literally in the same block of area. I just crossed the invisible line that made my car the target.

towing companies in every florida city suck.
its unbelievable how many innocent people they tow.
gainesville is one of the worst, ive been to ybor and know its bad there too, thats why i always just pay to park while im there.

^yah. at least create something legal that makes them deal with paper work and ****. file a complaint to the BBB, go take pictures of your car and the parking lot. make a better diagram for court though. lol

red: Tow away sign


just above the tow away sign is a small road so you can pass the tow away sign and park in between those 2 buildings

Im not really understanding this. You were parked in that yellow square and the red line is the sign that Im guessing said no parking tow away zone and the sign was facing your car? Cant really picture the situation.

the sign was facing my car, yes. But behind the sign was another lot that people can park in... so it was assumed that beyond the tow away zone sign was the actual tow away zone.

as far as im concerned, i was in the same lot as the rest of the people in that picture, yet they are not in a tow away zone.

This.

OP you can't take any recourse. If you can't figure out that you can't park in the little square then you aren't the sharpest knife in the block.

Private property, they can tow anyone they want, at anytime for any damn reason.

Regardless of any signs they have the right to tow your car if its private property. Its would be like someone parking in your driveway. You dont need a sign telling someone you will tow their car away do you?

You have no legal recourse. I suggest parking in a public lot next time you go there...

yeah.. you're right about that. Only thing that really bugs me is that I wouldve been in the public lot if i literally pulled forward 5 feet.

I'm still going to speak to someone about it, I'm not hell bent on it. If the attorney says he for sure can win it, ill go for it, if not, then whatever works.

It seems you were rightfully towed it makes no sense that the sign would apply to vehciles parked behind it. I cant say 100% as I am going on the info your saying and not having seen the lot but it seems you have no case. Not trying to be disrespectful or anything but based on the info ive seen i would say guilty.

is there a road separating the sign and your car or is it all connected? if it's all connected, you pretty much have no standing in court. just because they towed you out of everyone else doesn't mean a thing. that's like you speeding down the road with 5 other cars and the cop decides to pull you over out of everyone; in the end you still speeded and they caught you.

as far as i know, that doesn't look like a private lot, looks more like a business building. if it's a business building, they need to specify that it's a private lot and not for public use. apparently in this case, they did state it was a private lot.

A. Hiring a lawyer will outweigh the cost of the tow
B. Opening a small claims case against them will outweigh the cost of the tow
C. You clearly parked in front of a 'no parking' sign

Sounds like you are just upset that you were the 'only one' who got towed. Its no different than when you are stopped by the police for speeding. You can't tell the officer that its unlawful for him to ticket you because he didn't stop everyone else who was speeding on the same road.
