I'm talking freeway driving, on a regular highway it is fine to pass wherever. On the freeway, yes, a vehicle impeding a faster moving vehicle should get ticket, but usually the one passing on the right will instead. That's why I always stick to the flashers.

But if you can show me something that says that passing on the right is legal, even on a freeway, then you've officially created one more reckless driver. Following that "rule" has probably kept me a lot safer... especially when stuck behind Joe Slow going 60 in the far left lane, hoping for him to get over...

Hell, thinking about it more I got a ticket for NOT passing on the right... I was following someone a little too close up I15 by Tremonton, right lane was clear, cop saw me from the other direction and flipped a U turn and pulled me over. To think I would've been fine if I just went around the jackass...

So then is it more lawful to pass someone on the right of 2 lanes, or to ride their ass like the pony your parents never bought you? I would assume that it would be FAR less reckless to move around them than to tailgate them.

You'd think so, until they start to get over without checking their right side blind spot... I learned my lesson after getting pulled over twice for following too close though. So now I just flash my brights. It's also illegal not to yield to someone who is signalling, but **** if anyone does that in Utah.

I miss the Porsche for this reason, people yielded to it left and right on the freeway. Too bad our cop Evo friend left, or I'd ask him, he was the law master.

Passing upon right -- When permissible.
(1) The operator of a vehicle may overtake and pass on the right of another vehicle only:
(a) when the vehicle overtaken is making or preparing to make a left turn; or
(b) on a roadway with unobstructed pavement of sufficient width for two or more lines of vehicles moving lawfully in the direction being traveled by the overtaking vehicle.
(2) The operator of a vehicle may overtake and pass another vehicle on the right only under conditions permitting the movement with safety.
(3) The operator of a vehicle may not overtake and pass another vehicle if the movement is made by driving off the roadway.

I never did suggest that those are your only options. There is always a third option.

And apparently it's been a while since you've been in a car with kids screaming "I HAVE TO PEEEE!!!!".

No one suggested those were the only two options. When I got my following too close tickets I never realized I was following too close, too much track time will do that to you (Though the second time I still argue I wasn't following too close, but it was a warning anyway). I always come up close, then slow down, then flash my brights. Now thanks to Helmut I know I can just see the obstructing traffic, and go around on the right.

No you don't. You don't have to sign anything. If a cop comes to your door and asks if he/she can come in, you don't have to sign a paper saying yes. Most people just don't realize that by saying yes they're essentially waiving much of their 4th Amendment protection against unreasonable search and seizure.

My frustration is that there is no "right" way to drive in Utah. We were strictly told in driver's ed that it was illegal to change lanes at an intersection, no bars on that.

But you also have to remember, most of us get pissed if someone is going 62 in a 65. We forget that the road signs don't mean Suggested Speed, but actually Speed LIMIT. We should all be driving LESS THAN the limit to be in compliance with local traffic laws. Doesn't mean anybody does. Simply put, breaking the law is breaking the law. And if we do things we shouldn't ought to, we deserve the penalty.

Fornication is also illegal in Utah, but it's not like anybody is gonna enforce that.





That said, I still think that the OP should fight it. Had the same thing happened to me (and it almost did in South Jordan in December), I would have fought it tooth and nail.

It was more like "Oh, sorry, what is the rule for following too closely? I thought it was a car length for the freeway"

"No, a car length per every 10 mph is what we suggest, though it is 10 feet per every 10 mph"

"Oh, good to know, I'm very sorry"

"That's okay, be careful out there, I know you were speeding too but I'll let you off with this following too close ticket instead"

Second time it was:

"You slowed down too fast, you need to come to a stop slower, I can stop as fast as you, but the cars behind me may not be able to. I'm also pulling you over for following too close."

"Uh, what?"

"I'm pulling you over for following too close, but I'm just gonna let you off with a warning, take it easy out there"

Leaves without even taking any of my information. ******* knew he was following me too close, since I barely pushed the brakes and he had to swerve a little to miss hitting me when he pulled me over. Your cruiser stop as fast as an Evo? I doubt it.

Every state has wacky laws. If you think Utah's sex laws are strange, look up some of the statutes from the deep south states.
