Default ok, need some ideas on what to do if my stuff doesn't ship (legal action)

So, I told the guy that if it doesn't ship by this friday or I don't have my money back I'm taking legal action.
I'm pretty serious about that consdering I'm pissed and want something out of this.

my car now makes wonderful sounds. I think my front driver side caliper has seized, cuz it makes a beautiful sound.
I don't want to fix it, becasue I'm wiating on my engine (which is coming with brakes.) ahahah I'm conisdering just take the pads out of that side for nwo and not driving the car until I drop it off for the swap.


needles to say, I'm PISSED becuse this shouldn't have happend.
So, if I don't have my stuff by friday, I really want to throw the smack down.
So my questions
1. what am I lookin at in terms of cost (if I get a lawyer)
2. should I get one? or should i just do it myself
3. $5,300 is small claims court right?

4. what am I getting myself into.

Depends on the state, $5000 is the limit on small claims in CA. You could still raise a case, but you could only ask for $5000.
Hope he's in the same state as you.

A non-expensive lawyer will be $50-$100 an hr. So basically at $100 an hr you are looking at 50 hrs of their time before it becomes pointless. The good news being that you'll end up costing the other guy $ too. If you know anyone who is a lawyer I'd have them write a letter to at least show intent.

How did you pay for the item? Hopefully by personal check so you have a record of him cashing it.

was actually done via certified check. I have the recipt with his name on it, as well as every conversation we have (via email/pm).

Keith, find a local legal aid group that will give you advice for free on your issue. You probably qualify for help since you are a student (i.e., poor). University of MD Law School probably has a free legal clinic, though I don't know what they do when school is out.

get your money back buy the type RA that gr8wheels just imported.

where is it comming from btw? It takes along time to ship something that big...I ordered a transmisison from a junkyard in missouri and it took 2 weeks to get here on a semi..and that was just a trans.

If he isn't in the same state, take his ass to court the travel charges alone will make him give you your money right away. But dont you have to serve papers by hand to him the first time??

it hasn't shipped yet. I'm not waiting on the delivery, I'm waiting on the shipping.
As for getting my money back, thats what I'm trying to do ehhe

thanks for the advice guys...I HOPE I don't have to do any of this crap, but I want to be prepared if I have to.
Btw, I "know people" in his area ( I know people everwhere..espically from this club) so if *I* have to hand deliver papers to him, I'm sure it could be done.

prepare for a tracking number on Friday that doesn't work, and the item actually still not being shipped.

Keif, be careful with that locked caliper, my girlfriend locked a caliper on her old car, but since she was getting rid of it in a few weeks, we let it go. The week before we were going to get rid of the car, it finally crapped out and blew a line on the caliper. The brakes failed completely, but luckily she was in a parking lot, so she just coasted to a stop. Still scary.

Good luck with the engine, be sure to kick his arse once you install the engine.

I just listened to it and it sounds like its the rear drum.
I'm considering just takeing it off for the time being considering I don't drive the car much, unless needed.
I also have RS brakes on the front, so that can "compensate" for the brok3ed brake. I just don't know how I'm going to do it..I never touched drum brakes.
any advice?!

btw colin, I'm totally expecting to do that, I'm just going to have to get some money together considering I'm getting assrapped finanically right now.
