Default Maryland Legislature Approves Statewide, Freeway Speed Cameras

The Maryland General Assembly yesterday gave final approval to a measure that will expand the use of speed cameras to every part of the state, allowing cameras on high-volume freeways for the first time. Lawmakers in Annapolis, at the urging of Governor Martin O'Malley (D), saw the measure as an essential means of reining in the state's run-away budget deficit. Traffic camera vendors also helped promote the effort with lavish gifts, parties and campaign donations.

The new legislation specifically authorizes the use of speed cameras anywhere in the state up to one-half a mile away from a school zone. School zone cameras can operate as late as 8pm and ticket motorists regardless of whether school is in session. It also creates a statewide freeway camera program designed to be used in so-called "work zones" where the speed limit is lowered, regardless of whether workers are actually present. On a freeway that ordinarily has a 55 MPH speed limit, for example, citations would be issued to anyone driving 57 MPH in the lowered speed zone. For-profit private companies are authorized to take charge of all aspects of the program.

Lawmakers turned aside a number of amendments intended to clarify the true purpose of the program. One rejected provision would have returned any profit from the program to the public in the form of a tax credit. Another would have required weekly calibrations be performed to ensure the accuracy of the tickets. Lawmakers also rejected an amendment that would have ensured that state legislators were not exempt from receiving photo radar tickets. They also turned down an amendment that would have printed on each ticket the names of lawmakers responsible for voting the camera bill into law.

The only limitation adopted was a provision limiting cities from using speed cameras to increase their general fund budgets by more than ten percent. This amendment was aimed at Chevy Chase, which doubled its annual revenue with photo ticketing.

Nothing's wrong with obeying the speed limits. It's the law that's the problem. It's filled with loopholes and potential for abuse.

What if you're driving a car with an incorrectly calibrated speedometer? You could end up getting tickets when you thought you were obeying the law. The margin between obeying and disobeying the law is much too slim.

At least if you're pulled over by a trooper you can plead your case.

Speed laws have always been cases of strict liability. It doesn't matter what you believed or when or how you knew it. If you're breaking a speed law, you're responsible.

If you've ever been pulled over, you know that to not be the case. Officers have discretion to issue warnings and/or lower the severity of tickets.

I find it funny how many people are trying to defend this. How about this for a thought, drugs are illegal, so lets have mandatory drug tests every time you go and check the mail. How about every time you start your car a report is sent to a central private corporate office that works for profit giving the exact standing of your car and if it fails (i.e. no cats) then you get a nice ticket. How about the government hire the sister company of the previously mentioned to keep track of every dollar that you get and spend. After all, if you are not doing anything illegal then you don't have to worry about it, right?

Oh and as a finale, lets have members of the government be completely immune to all of these things as they are "respectable" and would never do anything wrong.

I can't believe anyone could think that that is what this is about?! It is about privacy, the right to face your accuser, extenuating circumstances--there are so many things wrong with this it is incredible anyone would support it.

I'm not one to defend cameras and their use, however reading the above the cameras are only to be used 1/2mile away from a school or during road works; as such it is not as bad as it seems.
The problem is that once they are used for the above, then their use will spread .. but that is another issue really.

The other issue is that MD at least on 95 has a problem with actually posting the changed speed limit for a construction zone. You can literally be 1 or 2 miles into the damn zone before you see the first sign.
