Fender benders stink. . .
So Friday morning while driving to school I got into an accident.
No one was hurt and the damage was not to bad but a brand new WRX was hurt. The Honda that hit me however broke an axle I know that isn't funny but it did make me smile in the whole scheme of things. To the reason for the post: I got cited for the accident for "Failure to yield from a stop sign" and after a little research on the law 28-773B it seems to state that I would have to hit the other car when i was turning from the stop sign. The impact however was about 25 yards from the stop sign in the right lane of a two lane street. I was however crowding the line so i would not hit a biker who was on my right, I do not believe I was in her lane at all. So i am debating if i should go to traffic court and try and fight the citation or should take the penalty and go on with my life. I am a 17 year old, this car was bought for me by my parents. So i have to also take into account that their are no witnesses besides the 40 year old and me, and last i checked i would believe that the 40 year old would be given the benefit of the doubt in this case and fault would be put to me. Just wondering what everyone has to say about this. Also if anyone has recommendations for body shops around the chandler, ahwatukee area that would be wonderful. This may just be me being paranoid but does the wheel look to be tapered in? And how could i check this myself

If you feel you have a case against it, the by all means. Take it to court
I think the wheel looks fine. |

try traffic school. its cheap and doesnt get reported to your insurance. just remember, if you lose in court your looking at another 30-50 dollars in court fees.
but like you say you were crowding the line, you could be cited for failure to drive in one lane as well. if you were over the line then by all means the accident was your fault. you might have been cited for failure to yield because if the other person had to swerve to avoid you making the turn. if the accident resulted from that action then that would be a good ticket to give you. was the officer a motorcycle cop? if so i wouldnt fight it, traffic enforcement and accidents are all they do. id suck up the ticket, take traffic school so the ticket doesnt get reported to your insurance and chalk this on up to a life lesson. hell when i was your age i drove my moms car into the garage door. |

It was however not a motorcycle cop he was in a police interceptor = D Also the accident was not from me turning at all i was on the road well away from the stop sign that is the reason i would want to go to court about it. |

ah the law cracks me up... unless he was 6 feet over the line, there is no WAY the other car should have hit him. thats like the retards that take left turns into the middle lane and almost hit you.. was it my fault for being right on the crosswalk and next to the yellow? noooooooooo

If I showed up to the scene and saw a black WRX that was driving in the curb lane with damage on the front left fender and the driver stated he had to move over to pass a bicycle, and the other driver has damage to the right side and they say he came into my lane...all the evidence and statements point to him crossing the line. As far as the stop sign thing. 25 yards is pretty close to the intersection and could very well be considered "intersection related" depending on the actual distance and configuration of the intersection. Now if the other driver stated to the officer they had to change speed/direction/lane because you pulled out that would be not "yielding to through traffic". It sounds like the officer did a pretty good job of letting you off light. Im pretty sure if he wanted to he could have written you a few more tickets. |

My wife took her Mustang to a place on 75th av a little south of Bell Rd. Its across the street from the ice skating place. They did an awesome job. Some dude trusted them with an old school car show quality Mustang GT 500 that was absolutely beautiful.
