Thumbs down It's time to go FOIA on the state of Maryland!

I sent the Montgomery County "speed camera" people the following email:

I would to request information regarding the county's policies and
guidelines that guide the distribution of notices of violation, in
particular, those that influence the timeliness of the notices. This
includes, but is not limited to: any policies that establish a maximum,
minimum, or preferred timeframe from the date of the violation to the
date the violation is sent; as well as departmental decisions on
staffing that affect the ability of the department to provide
notification of violation in a timely manner. Please let me know if
this request needs to be made under the Maryland Public Information Act,
State Government Article §§10-611 to 628. Thank you.
They responded:

So be it. It's FOIA time!

They installed speed cameras on the road my wife drives to work each day. They give you a 10mph over buffer zone before they ticket you. My wife got a ticket in the mail last week going 11mph over. Shame on her. Lesson learned. Yada yada yada. Well she got two more in the mail this week--all for 11 over. The thing is, she didn't get the first ticket in the mail until all three tickets had been issued. It took three weeks for the tickets to get to us.

Now, I don't begrudge them the speed cameras or the ticket we got--but if they are going to tell the public that the goal is specifically to make the roads safer and not to generate revenue, then they need to have a damned good explanation for why it takes three weeks. To me that says that they're trying to milk daily commuters for as much as they can before they let them know that they are driving past a speed camera and getting ticketed. Whereas if the tickets were issued in a timely manner, the speeding would cease all that more quickly.

Unless you are blind, which you shouldn't be driving if you are, you will see the multiple flashes of light as your picture is taken even during the day. Oh, and get used to it. That piece of **** Janet Napolitano is now over there screwing things up for you guys. You will be seeing more speed cameras all over the highways there, I'm sure. Ask AZ residents how that is working out when traffic is stopped because people slam on their brakes at the cameras and everyone drives below the speed limit now.

from the way I read it he wants to know the timeline from committing the infraction to receiving the infraction notice in the mail. he thinks the state/municipality is purposely holding back the original notifications to potentially increase the revenue from an individual

Better to shoot them with a really accurate paintball gun, and occlude the lens. Or figure out where the wires go, and cut them.

It's a crappy deal, but I doubt it would change anything.

And once the fines are paid, remember to keep the receipts in a special envelope & mark it. I'm willing to bet a few years from now, you will get some kind of a statement, accusing you of not paying some ticket years before. It happened to me twice. Talk about creative accounting.

In NC, the flash happens behind you, and isn't that bright. It would be really easy to miss it.

if only they cost us anything we could bitch. Lockheed-Martin is the primary supplier (at no cost to the jurisdiction I might add). They have a revenue sharing plan with the po-po (proving they're profit and not safety driven).

This is one of the many reasons I moved out of Montgomery County. The whole system is BS.

Those tickets are presented as civil matters, different from a cop handing you a ticket. Sending an uncertified letter is not they way civil claims are started by citizens. If I want to sue somebody, they have to be served and give a witnessed signature. Whatever agency runs this camera program is essentially taking a liberty that we don't have. Fines, extra fees, and criminal charges could pile up against you for a letter that you may have never received (or in this case, took their sweet time getting to you). I'd image they'd come find you at some point if you didn't pay, but the matter will have been escalated significantly by that point.

My wife got red light tickets on consecutive days at the same intersection in Silver Spring. She didn't run the red lights. She was stopped in the intersection because of a traffic jam. She was just clearing the intersection, apparently after the light had changed, and it triggered the camera.

It's my understanding that clearing an intersection as the lights change is not a moving violation. If they want to tickets her for stopping in the intersection, that might be a different story. But, as it was written, she was falsely accused of failing to stop.

Don't over analyze it. It's a gov't entity and therefore horribly inefficient.


That said, I COMPLETELY disagree with speed cameras. F*** that noise man. In fact, I disagree with all ticket cameras. Look, tickets may be a revenue source, but when you turn to them for a guaranteed income like cameras provide...it's time to do something else. Raise property taxes, sales taxes etc. I'd rather pay higher taxes than get 3 damn tickets for 11mph over. WTF is the difference between 10 and 11? That's why officer discretion is good. And it doesn't teach the bad speeders anything. So much of that learning experience is from the blues in your rearview and a cop in mirrored sunglasses chewing your ass for going 30 over. OK fine, it was 28 over, and I was 17 on a motorcycle, but still, the lesson stuck with me. A ticket in the mail....
