Default 2003 wrx automatic problem

Hey guys, ive noticed this a FEW times, while commuting home from school. I have a uphill climb, and certain spots it requires a shift into 3rd and second, but every once in a while, on relatively level parts of the road, the transmission will refuse to shift into the final gear, causing me to be running @ around 3-4k at 40-50 mph, when i know it should have shifted and dropped down to 2.5k... checked fluid, not burnt or low,( maybe a cm high on dipstick, but that shouldnt be a problem), anything else besides needing a rebuild?
