Default Broken Lug Nuts?!

OK, Here is my delema, I had my 37,500 miles service done the other day, and had the dealer put on my snows while there. The ended up breaking 2 lug nuts while removing my Rota SDRs with the nuts that came with them from Subydude. Anchor Subaru claim that they were doing nothing out of the ordinary to remove these lug nuts, and the broke due to over tighteneing. I have spoken with a few people I know that work with a lot of cars and they have said that lug nuts don't break from over tightening, and that if that was the case, the studs should have broken. I'm looking for everyones opinion here as to weather or not I should be responsible for these broken lug nuts or if it should be on the dealer. They then went on to charge me $79 an hour for 2.5 hours to drill the lug nuts to pieces and in the process do this to my rim:






I am also wonder what anyone thinks of this damage to the rim, and weather or not I sould drive on it again come springtime. The dealer says it was purely comsetic and I will be "fine". I have also e-mailed subydude to see what he thinks and will add his comments onto this post when I get them.
