Default Accident! What to do?

Hey
i got in an accident the other day.
i saw him at the last min. hit my brakes but it was too late.
anyway...i mess up his rear section pretty bad.
the metal under the trunk carpet is all bent...he can't get his spare out or anything like that.
his bumper has about a 4x6 in dent.
wrx has no just a little scratch...but the front was pushed in a lil.
engine is fine

anyway...it turns out he has no insurance.
i gave him my license number...

what should i do?
i know that it is illegal to drive without insurance.
would that void my responsibilities for hitting him...cuz he shouldn't have been on the road?

can he get my address from my license number?

what should i do!
i don't want insurance company to be any part of this cuz it would cost me more in long run.
im only 18.
but i don't feel like paying for all his damage...and then mine!


please...i need your help!!

From the description it sounds like it was your fault. This means you or your insurance company is going to have to fix the damages on both cars. Him not having insurance is not a loophole for you as long as it is your fault. So unless you got a couple spare thousand dollars layin around your insurance is gonna have to pay for it. Yes he can contact you through your license number, you didn't perchance file a police reports did you??? That should of been the first thing you did.....But here's the bad news, with you being 18 thats gonna drive your insurance premiums through the roof.

im goign to call first thing tommorow.
in california...it is the law to have insurance.
this guy didn't...
so why the **** should he be able to drive around without it...risking getting hit or hitting someone else....then one day get hit, and not have to pay anything?
this is the reason to have insurance...to settle situations like this.
they have non-collision insurance where the actions of the driver are covered...but damages to driver's car isn't!
i believe that was invented to lower the cost of insurance so people could would be able to follow the law!

how can someone drive around without insurance, get hit one day, and not suffer for breaking the law?

he took the risk...so he has to repair the car himself...

Yeah blame someone for you own poor driving.

You should have gotten a police report too. He may call Johnny Cockren and show up in full body cast.

Listen closely mmmkkkayyy.......
He CAN get in trouble for driving around without insurance, it's called a citation and he'll prolly have to show up in court for it. But if the accident is your fault why do you think you should get out of it just because HE DOESN'T have insurance???? That makes no sense whatsoever...You are legally obligated to pay his expenses and he can/will sue you if you don't. Even if he did have insurance it would not come into play in this situation anyway because it's your fault!!! You have also broken the law by not fileing a police report in this case because more than 500 dollars of damage has occured. So basically you need to settle this quickly before he sues you and you lose your insurance...

Chances are his license will get suspended until he gets insurance and he may get a citation as well. I don't know how that works in California. It looks like you don't need to report the accident to the police, but rather the DMV, within 10 days. If he doesn't report the violation it looks like he can get his license suspended for 4 years. If you don't make the report, your license can be suspended as well. It really sounds like you should have exchanged phone numbers and worked the problem out on your own, and that would have benefitted both parties...

Here's the best deal for you - report it to your insurance agent, tell them what happened. Also report this to the police too - yuor agent may ask you to anyway. This will stick in your records for awhile - 3 years?? stay clean and you are back to having a clean slate. Or if you are in IL, you might qualify for traffic school if you have a clean record, go for driving school and this doesn't get into your record. Stay clean, get good grades and traffic school may get you cheaper insurance.

Here's why :

The driver that you hit could come back against you - for more than just damages to his car. Have you heard of pain and suffering? the pain in his back that wouldn't go away .. whiplash and chiropractor bills that don't end? He doesn't have insurance - so how responsible is he? how "straight" is he? He can really hurt you or your parents ... if the car is not yours. If the car is yours, you can stand the chance of losing it, and paying him and his attorney may be more than the increase in your insurance. :monkey: Sorry.

Gosh, I feel like a mommy right now.

Actually if I am not mistaken, California passed a law that DUI, people committing crimes, and uninsured motorists cannot sue for "pain and suffering". I believe this passed a year or so ago.

Talk to the guy. If the damage to his car is less than what his fine would be for driving without insurance, then tell him that this would be a wash. Or just pay for his damage, minus what the fine for driving without insurance would be, and tell your insurance company that someone backed into you at a parking lot and ran. Either way, you're gonna have to report this to you Insurance company or the cops. Talk to the other dude and work something out.

You need to report it, TELL THEM you intend to NOT make a claim and pay it yourself, if you can, and see how bad the damage is.

Even if he HAD insurance, YOU would be responsible for his damages.

Hey you got insurance right? Unless you can afford the damage yourself, report the accident to them and bend over for the raise in your premiums. Ive been in three accidents that were my fault. Luckily one of those has dropped by now and one will drop next year. I know it sucks cause anything can happen at any second on the road. Believe me. The last accident that was my fault I just looked away from the road for ONE second and that was all it took for the lady in front of me to stop to let someone else get in front of her. And that was all it took for me to hit her as well.

My friend is very unlucky. He totalled my brand new RS and also shoverd me into 2 other vehicles from a dead stop! He didnt have insurance. He HAS to pay three insurance companies from his own pocket plus he has to pay for everyones deductibles. He is going to be paying about $30,000 for the rest of his life.

The worst that'll happen to you is paying a higher insurance rate. It's only money. At least you lived, and your car is in good shape. If you gotta switch to another insurance compant I'd suggest Progressive. Every other insurance company I checked with wanted about 3000 every 6 months for coverage. Progressive only wants about $1070. Good luck man.

this is why part of your monthly insurance premium goes to uninsured motorists...

deal with it and report it.
