I was without a car for 6 months while I traveled to Phoenix, decided to move back to Alaska, and took the bus everywhere, which I was fine with because I find public transportation exciting. Public transportation isn't convenient, however, so when my mom and I saw the Nissan Pathfinder for sale, we jumped on it. I was totally cool with that thing, too. I picked up my friends and their bikes. I packed stuff in it. It was really cool. I'd twirl it around corners since it was RWD. I think I had that for about 3 years. Then one day a new friend of mine showed me his 2.5 RS coupe in black and man did I fall in love. I had no clue about AWD, really. I just loved the designed, front to back, top to bottom. It just flowed. Shortly afterwards he sold it to me for about $8k. For a while I was in heaven, completely content. Everything was great as I discovered the power of AWD. I loved that I had a coupe because before I was getting harassed all the time for rides or to help pick up people's stuff with the Pathfinder. Eventually, though, the RS started falling apart. It had gone through several owners before me that didn't take care of it and I was getting all the issues. My buddy had purchased it off eBay from the Lower 48 and only had it a couple of months before he sold it to me, so he narrowly missed having to deal with it. After pumping thousands of dollars into that car and getting deeper into depth with it, I finally hit my last straw when the 2nd used motor spun a rod bearing. An automatic RS completely unmodded, dead in the water. I was SO furious that I parked the car and looked for a used Subaru that was everything my RS wasn't: turbocharged, maybe bigger spoiler, and, most importantly, running. I was looking at the WRX and Evo until I saw this thing called an "STi"? After some research and number crunching I realized I COULD afford the STI as a 2005MY, so I found one and had it shipped up to Alaska. That car was AWESOME, but I never used it for it's purpose. I didn't even enjoy the DCCD until the week I was selling the car. Also I started hollering at a co-worker and was thinking "family", so my brain zeroed in on the 2008 Forester Sports XT (which she really liked, so that was a bonus). I found one through Autotrader.com in Park City, UT, and roadtripped that up to Alaska. I had a lot of plans for that car and my future, but eventually decided that I wanted to stay single for a bit longer (I decided her and I needed time to grow up), so the Forester no longer served a purpose. Plus I just REALLY wasn't ever comfortable with all the extra cabin space that I had to negotiate every time I looked behind me. I was determined to stick with the Forester since there wasn't much else that interested me, but then Phil and Hope on separate occasions both told me to take a look at the new WRX since it's redesign was about to be revealed. I waited and BOY did I fall in love! I feel in love with the exterior, with all the curves and aggressive stance. What wasn't to love? At that point I had to decide what was more valuable to me between the WRX, STI and even the newly designed Legacy GT. In the end I decided that the WRX Limited was the best value because I mostly wanted a competent daily driver that had sporty driving characteristics, and the Forester made me REALLY love having a sunroof and cupholders. In the two years since I got the WRX, I've learned that compared to the available STI the WRX really is a compromised piece of machinery. It's really tough to swallow it's faults when you know something like the STI exists. It's kind of like "you get what you pay for" with these cars. Personally, with the transmission crunching and the clutch sticking and the uber negative stigma that came with the car, plus life changes of home and work, I just never really had a chance to love the car. I did my best to love it by taking it on roadtrips and activities, but it just never inspired confidence in me and just seemed like it needed a lot of work to be satisfactory. Now that most of my friends are married or moved away and my little niece and nephew are no longer in Alaska, I pretty much only ever have myself and sometimes one other person in my car. I love to drive around a lot since I do appreciate how beautiful Alaska can be, but with gas prices being so high, you really have to plan your routes these days. Also the maintenance of turbocharged, AWD vehicles just gnaws at me constantly. When the cons outweigh the pros, that's when the car has to go. If I could keep each car I've owned all at the same time, I totally would. They're each awesome in their own way. Yet, I can only justify their use in my life so often as my life continues to change. If I at least had a girlfriend or was even married or had kids, there's NO WAY I'd do all this switching around. Trust me. If I had anyone else to consider, things would be different. Right now, though, I'm at a stage where I'm single, I need something more fuel-efficient because I drive a lot, I want it to be fun to drive, I want it to be familiar, I want a car that I can take with me when I move out of Alaska that won't be overkill for warm climate by having gas-guzzling AWD, and I don't want a turbo with all that plumbing involved. And, after reading that wall of text I've come to the conclusion that you should have bought my car instead. We'll do a few roadtrips when the roads are ice and/or snow.

Reading this story brought back a lot of long suppressed episodes of similar events. Take a moment to read through this story and do me the favor of placing yourself in each one of these three individuals lives through this ordeal. Imagine how hard the young teacher had worked to get through school to her dream job. The good she could have done in the world. Imagine that kind of pain***8230;. of having your skull crushed only to wake up and not have the mental capacity to function as you were before an accident not of your fault. And you have to live the rest of your life that way. Imagine being her boyfriend, watching someone you love and had a great future with***8230;.wither in agony as you are healing your own wounds. Imagine the bitterness you would harbor. Imagine being 22, having to sit in a cell, everyday, for the next 8 years, living with that level of guilt on your conscious. "Tex Daniels has had his life changed too".(!?) He has to spend time in a cell and may not even do all the time he was sentenced to serve. I reckon some of the tears he shed were for himself, IMHO. Users of any drug are slaves to their poison of choice their whole lives. I can say from agonizing personal experience that users will almost always use again regardless of the impact on anyone around them. This Tex Daniels could serve his time and walk out of prison an able-bodied man. The people he hit with a truck will likely never be the same. Sadly once released Tex is statistically likely to do this all over again. Eat, drink and be merry. Enjoy life. If you plan on more than one drink in two hours time then have a plan to get home which doesn't involve getting behind the wheel of a vehicle. Period. It's doubtless Tex knew this and made the decision to roll the dice anyway. He had his life changed, too? I say the change wasn't drastic enough.

I may be playing devil's advocate here...but was the couple intoxicated as well? Could they have taken more precaution that could have avoided this situation where they are the ones that lose?
Sure..no one deserves what happened to them, and the 22 year old is being punished appropriately imho...hell I'm all for a longer sentence...But if they hadn't been in the wrong place at the wrong time this wouldn't have happened to them. If the couple had been drinking...did it play enough of a role to make them less aware of their surroundings possibly leaving them in a position unable to possibly react to the truck that hit them? Would a sober person have been able to react in a way to avoid getting hit? From the accounts they were walking north on I street...which means they weren't walking against traffic which means they probably weren't aware of the truck coming, sober or not. The defensive thing to do would have been to take a route that wouldn't have left you in that situation that you can't see what's coming from behind you. This whole story just reminds me of the driving mantra of defensive driving "All accidents are preventable". It's the same reason why some people park in the back of parking lots...they avoid parking next to other cars because they don't want people to ding their doors. All in all, it's a ****ty situation and shouldn't of happened, but part of avoiding accidents is to take precautions to make sure you aren't in the wrong place at the wrong time...and be a smart pedestrian as well as a smart driver. He was doing 50 mph in a 30 area, .226 bac, tried to leave the scene and your trying to say the walkers should have taken a different route? Do you do that when/if you go out? Another way of looking at it is if he hit a car instead of people walking, would you say the same thing?
People make bad choices, this one was huge!! Not trying to be an ass or try and read too much into your post but I don't think I've ever heard defensive walking. In my opinion, he could have just gotten a cab with a .226 bac or even walk home but thats what alcohol does to you, easy to make bad choices. Drinking and driving is a stupid choice. |

I'd say the same thing if he had hit a car. My car even.
And no Alex..that's not my point. I'm NOT blaming the couple..I'm simply asking if there was something they could have done smarter that would have prevented something they have to live with for the rest of their lives. Him sitting in jail isn't going to change the fact that the girl is going to have to live with those injuries for the rest of her life. I actually think he shouldn't have been drinking at all.. He definitely shouldn't have walked home...someone would have ended up hitting him instead...This is why I don't drink except the very rare occasion. But...This isn't about what the dude did wrong..because there's a lot of things he could have changed about that night to prevent what happened..that is undeniable - that is why he is going to jail..because it's OBVIOUS he ****ed up. But my question/point is...the couple could have probably done things differently too to prevent/lesson the impact of this accident on their lives. I've seen people WALKING in the middle of the highway before when I worked swing shift and got off at 1am. I've had people jaywalk in front of me too.. If I hit them..should I go to jail? Obviously these situations are theoretical/not close to what actually happened...and what transpired was real..but I'm just trying to point out that you have some control in situations that seem uncontrollable. So...drive smart...and walk smart. You don't want to put yourself in the situation that you're the one that gets your life changed by a drunk driver. Look both ways when you cross the street even when you have the greenman...don't walk with your back to traffic..avoid going out when you know people are going to be drinking and driving like New Years...wear reflective items. Try and stay alert of the vehicles around you. The decisions you make as a pedestrian can make a difference too. |

Last I heard it's actually illegal to ride your bike or walk against traffic, so they wouldn't have had proper heads up anyways with the vehicle going in the same direction as they were walking.
I agree, though, I break the law by going against traffic. I hate the thought of someone getting the jump on me. I used to work downtown and was a defensive pedestrian constantly. |
