Or... you could just use software to unlock the bios of the phone... but whatever.

Hit or miss.
Sometimes it requires you to modify the original SIM to gain access to the network.
Also you have to screw around with the APN and other settings for it work right.
A software/baseband unlock is a MUCH better option.

I would assume the protocal for the iphone would be different for some reason, the contract is 90 pages long.

It depends on the manufacturer. AT&T will just say it's not possible to unlock it and try to sell you an overseas roaming plan.
When I got my HTC Dash unlocked T-Mobile had to contact HTC to get the unlock code from my IMEI. If HTC had said they didn't have it, then it wouldn't be unlockable (at least by T-Mo)
