HIS clutch isn't going to be covered by any Subaru warranty! If he's lucky, the dealer will eat it - provided they don't claim he installed it after the sale.

What state are you in? Some states have lemon laws that will cover you.

well its the whole clutch assembly flywheel, clutch, and pressure plate would that make any difference?

I think the Lemon Law applies if it is repeat repairs for the same thing or it's not been driveable for a long time - but either eay, it's not an OEM part that broke, so I don't think the Lemon Law applies anyway.

The warranty you are quoting is for the OEM clutch components. With a non-Subaru part, no Subaru warranty. Did you call the dealer that sold it to you to ask them about taking care of it? Seems like that would be the first step in all of this. Any other mods on the car that you know about or that they told you about when they sold it?

On my 08 the clutch failed early, like less than 25k early. I bought it with .5 miles on it. The factory clutch always felt like I had to go through the floorboard to have it disengage. No mods except the stage I Cobb tune because 08's also had a stalling/idle dips like the 07's and that's the only way to fix it. Since SOA wouldn't cover it, I later had an ACT clutch installed, engagement didn't change. I even went so far as to build a brace for the pedal assembly so it wouldn't twist as much. I ended up trading the car in at a dealership, and a friend of a friend ended up buying it.
Long story short, the clutch engagement was weird because the metal that the pedal assembly mounts to had actually ripped..... It had to be riveted back together.

Lemon law won't apply here. Factory warranty doesn't either. The only thing you need to do is go to the dealer you bought it from and get them to put a factory clutch in since they neglected to tell you about the non factory clutch.

yes i called the dealer and said to bring it so they can look at it and a good possibility they will take care if it

Apparently Subaru does have a limited wear and tear warranty that is good for 3yr/36,000 miles. Items covered are brake pad/shoe linings, clutch linings, and wiper blades.
