Default OEM Win XP Home Edition Legal to sell?

I purchased a new laptop about 4 months ago and it came with XP Home Edition. The same day I purchased it, I reformatted and partitioned the drive to my preference and installed XP Pro and RH 9. It is sealed with a COA and never used nor registered. Is it legal to sell it? I will never use it.

From my understanding, it is legal as long as you include a piece of hardware with the OEM OS. Correct?

No. The OEM license can only be sold with it's original hardware. You can also not transfer the license to another PC.

That's how I've always understood it. Hell, it doesn't even need to be a functioning piece of hardware, all the eBayers just usually throw in a dead mouse.

I know an I.T. Firm that have sold them with a power cord, or any, I mean ANY piece of hardware lying around. It might not be ethical, but it isn't illegal, per say.

This is exactly what my company is trying to do. We have corp. WinXP Pro licensing, why should pay for it again when we purchase new machines? I was giving the task of actually find out the legalities for this, and I have yet to find any hard regulations on it, from Microsoft or otherwise. All I've found is "Must be sold with hardware".
