Default Guy pulled me over, Mal. He pulled me over with a bike. How weird is that?

Bicycle to be more specific.

Anyways, being the nice guy that I am I agreed to pick up my cousin from the airport tonight. 10:55pm, there he was, right where he should have been. I picked him up curbside and off we went.

I merged from the pick up lanes onto the right lane of the oval that links drivers to the different terminals, garages, etc. I decided to merge left to overtake some of the shuttles and buses that were occupying the lane I was in. I checked my blind spot to be sure just as I started to coast left when I noticed a bicycle cop riding there. I gingerly made my way back into the lane thinking, 'Well I'm sure he didn't like that'.

Given, I didn't move quickly enough for him to have to jerk left or make any sort of evasive maneuver. I just didn't see him.

Anyways, he stays with me and I knew it was only a matter of seconds. If he was going to pull me over it was going to be for my obnoxiously loud cat-back exhaust. Sure enough, he lit me up with two little flickering red signals so I pulled over, turned off the motor and waited.

"Good evening, officer"
"Good evening. Do you know why I pulled you over?"
"No sir, I don't"
"Can I see your license, registration and insurance?"
"Of course. My reg and insurance are in the glove, I'm going to open it"
"Is that the muffler that came with your car?"
"No sir"
"So it's aftermarket?"
"Yes sir, it's a cat-back, the catalytic converters are still present"
"You know that's against the law, right?"

I never disagree/argue with a cop, so of course my answer was 'Yes sir.'

"It doesn't matter what type of muffler it is, it is illegal to modify a car the minute it drives off of a show room floor."
"I understand sir."

He goes on to ask me if I have ever been pulled over for the same reason in the past to which I reply 'Yes, I have.' Then he asks why the exhaust is back on the car now.

Anyways, I have a fix it ticket.

Now.. I've been through this before and last time I went to court to fight it w/ papers in hand from Blitz stating the exhaust is 50 state legal. I also had evidence of a decibel and smog test both stating that the exhaust operates within the legal limits. Well the officer didn't show up that time.

I am going to fight this one because I'm not paying the insane 'bail' fee nor do I feel like putting my stock exhaust back on.

The thing I find strange is his statement that a car is illegal to modify the moment it leaves a dealership lot. So in that sense, if I changed my stock brake pads after they wore out to a brand that wasn't OEM, is that illegal?

Oh and where can I brush up on my California laws? www.ca.gov ?

Thanks gents. I will also be consulting a friend that is a LEO and actually works in that same area.

CN's: Pulled over by bicycle cop at airport. Receive fix it ticket for loud cat-back. Curious as to what actual law is.

this is the actual law in california. sorry to break the bad news to you.


i'm surprised you got a ticket though. next time try something like this.

"yes sir. I've been pulled over for it, in fact I just got pulled over yesterday. I was going to remove it today, but I didn't have enough time. First thing tomorrow its coming off."

got me off the hook 3 times. :P

Huh, no kidding? Good to know.

Well now that I do know I must say that is a load of ****.

Oh and nice theory but couldn't he have just checked his computer/radio and find out I was lying about being pulled over the day before?

(a) No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified.

I know it says "vehicle", but does this apply to motorcycles too? I wonder if hot rods get hassled too?

Then you'll be fine, but you'll need to be tested at a state-ref and carry the paper with you, and don't be surprised if you keep getting pulled over.

but the papers from Blitz say its 50 state legal! Blitz takes precident over law, duh!!!!!!!!!!!!

It won't show up until the citation goes through (if they even issued one) which is why you will see a lot of guys leave their mark on your registration.

Or if they were smaht they could ask you what dept. pulled you over and call up and inquire as to when you were pulled over. Lying never ends well

Maybe.

But around here it seems to depend on where one is when they are pulled over.

I've driven in front of/around cops in my neighborhood (Hollywood/West Hollywood) who haven't seemed to mind my loud exhaust.

But in a place like Northridge where rice runs rampant it's a different story.
