It still sounds pretty stupid all around. Going back to get a different color, BOTH sides failing to note the big change in the bottom line... either the buyer noticed and just hoped to get away with it, or he's stupid and didn't check.
That's possible, but a ton of paperwork still had to have been done to exchange the two cars.

In California, it is registered on-line with the DMV before you drive off the lot -- fees paid up front. At least it was last two cars I bought.

What California does seems a little extreme in the other direction from "I promise to pay you. Really."

Doesn't it seem like there should be some sort of consistency from state-to-state in car registration? These separate yet united states make it pretty confusing.

Not really.

It's not a house. Probably three or four pieces of paper need to be changed out.

I don't think it was a scam. I'd guess the dealership DID tell him he would owe 39K, but then gave him papers for 34K, which he signed and immediately came back to pay off w/ cashiers check.

A week later, when they close out the deal, they realize they ****ed up, call the police to try to activate the tracker. Cops say they can't activate the tracker w/o reporting it stolen, so sales manager says, "uhh...sure, it's stolen".

What do you mean "swap"? You can't just "swap" cars.
Technically it has to be sold (pretty much as a used car) back to the dealer, the registration has be be transferred and the black car needs to be purchased and registered. I'm thinking four hours, minimum.

When? Obviously when he bought the blue Traverse.
Did he also sign a final contract for the black car? Because he needs to -- different VIN and all...
Dealers have finance people there every minute they are open to read through this stuff before the car goes out the door. That is MULTIPLE people missing this.

The sales manager should have been jailed, or at least fired and made to pay the difference. The finance person should likewise be fired. After all, the main reason they have a finance person on site is because the meat-head car-seller dudes never passed algebra.

It was a super dick-head move arresting the buyer. Seeing as how the report is so poorly written, I assume we're only getting half of this. I'm guessing the guy got called out on the price difference before he ever left the dealership, called back over his shoulder as he was making his escape, "Too bad! I got the receipt and registration!" and sped off.

I wouldn't be surprised if this sort of scam was the buyer's intention all along.
as long as the car wasnt titled...they can sell it again as new...it happened to me...i bought a 2002 WRX and took it back the next day...the car wasnt titled and was still on the lot...i was in that respect...the manager got my car and put the plate back on and away i drove

that afternoon the fiance guy called me saying we didnt have to give you the car back and i should come back and take ownership of it...i said no i didnt like the deal and left regretting it and since i have my old car back im keeping it...they didnt call again

I know the Chevy and Dodge dealers here in Reno will let you take a car on a "24 hour test drive" where you drive it for a day, see if it fits in your garage, etc. They'll do anything to sell those heaps, I guess.

Dude may have taken the first Traverse home for a day just to flog it and see if he really liked it. Then went back to pick up the one that wasn't beat on for the first 50 miles.

Here is what I think people are missing

So this guy has a permanent record for GTA and was also an arrestee/convicted criminal (in the eyes of anyone who looked) for over 2 months...

That should cost the dealership some coin.



Here the govt registration and insurance is completed (VIN written on contract, license plate assigned and installed, temporary pink insurance card printed and all aforementioned docs given to the buyer) before the car rolls off the lot (at least in 95% of cases, I am sure a late pickup on a Friday afternoon sometimes has paperwork stuffed in an envelope and mailed out or hand-delivered on Saturday or the following Monday). So switching out VIN's would require internal paperwork and other changes. If what the customer did was an overnight test-drive that turned into a sale, then thats different. No idea if it was a bait-and-switch on the part of the dealer or if the customer was trying to evade the $5600 but either way the arrest was way too far. Small claims court or other options were available.

I hope they lose their 2 million. This is a drop in a bucket for them. I know of a certain priority dealership in my area who's marketing budget alone is 1.3 million a year.

If I was on a jury hearing this case, where the dealership lied and the police came to his house and hauled him out in cuffs, I would be voting for the customer and giving him 2.2 million.

shocked me too. They ran my credit and I'm sure one of the 99 forms said something like if you don't come with a check within 2 weeks, we'll just go ahead and finance it for you. Hell, they didn't even give a rip about insurance...I had to halt them to make a call to my agent before I left. Very strange that Priority Honda dealership. Salesman's name was Ron and I went from driving onto the lot with a 03 Pilot (transmission was shot....they missed that during trade-in) to driving off in a 11 Pilot in 2 hours. I don't **** around at dealerships. Oh, and EVERY new Honda on the lot had a $1000 to $3000 markup over sticker for "in demand fee" or some such BS.

You're missing Rogue's point, filing the suit period is justified action. Stop fixating on that amount of money because in reality he will be awarded nowhere near that amount. Most likely a few hundred thou at best, but still ahead of the game and teaching that dealership a harsh lesson. Whoever called the police probably already lost his job.

That's not what the lawsuit filed by the buyer states:

So between June 15 and Aug 23, the dealership was pressing criminal charges against the buyer. During that time, they apparently offered to drop the criminal charges in exchange for $5600, which is ironic because (as pj noted) only the police can drop felony charges.

In other words: the dealership was using the pending criminal case (that existed in the first place due to their false reporting of a stolen car) as leverage to extort money from the buyer.
