Angry found Guilty*

ya so today i went to newport news traffic court for a loud and excessive muffler ticket. for my SPT exhaust. i had pictures of 06's on the lot with the exhaust, the muffler in the display case, and of course my recipt and the spt parts catalog. ... the judge wouldnt even look at any of it. he said that if the officer thinks its to loud then it is and subaru needs to take it off the market.

also

he said the only exception he makes for these tickets is the SRT-4 neon, because they come loud from the factory WTF!

... and I bet them cruiser-Harley-whatever-bikes with exhausts so loud you can hear them for blocks never get the same ticket as you did!

this is all about street racing, not noise, or emissions.

I wonder if you could appeal the decision... i know its a hassle and not worth it but I would probably do it just on principal. That and I get irritated at these things when they have prejudice against a certain type of car.

If the judge says Subarus exhausts are too loud then I would forward the ticket to them and they should give you a spec sheet or something proving legality. I just can't believe how blind and nieve the "justice" system is.

Wow, just hearing your story ticks me off.

Anyway you can still fight it?

I'm not too familar with the excessive noise laws, but don't they have to go by a certain decibel (dB) rating?

As mentioned, it is complete B.S. that Harley's (and other loud cars/motorcycles) go untouched because "they come like that from the factory."

I think the question is - what recourse does he now have? From the story it doesn't sound like any readings were taken by the cop, so really, without those I don't think it would stand, but then again what's the appeal process for something like this?

im in sales, and pretty good at talking to people, if you guys would of seen the judge when i made my statment, i knew imediatly that he was not budging. i did refer to DB reading, and i brought up the 350, vett and harleys, he didnt give a dang!

I know in a lot of states its up to the cop to decide if any car is to loud which is complete crap especially since in your case its a dealer iteam. I just dont get how the juge can aprove of a ticket if he dident even look at the evedence.

Call SOA and tell them you are getting fined for there approved exhaust system. I'm just curious what they would say...

I wouldnt worry about it. What the judge says goes and you cant really do much about that so you might as well let it go. Just keep it on, I doubt it will happen again..

I had a friend with a mustang that moved to cali. He got a ticket because his neighbor said she saw him speeding. He has a loud mustang so it always sounds like he is speeding. It held up in court and he got a ticket for it. Good ol Republic of California.

I would have hired a lawyer. This is a perfect example of a judge that is not doing his job. You CANNOT have leniency for one type of car because its loud stock, and not another because its loud stock. He probably hates all aisans. A good lawyer would enjoy this type of case for its publicity. Biggot judge hates foreign cars! News at 11!

The VA law says:
" 46.2-1049. Exhaust system in good working order. No person shall drive and no owner of a motor vehicle shall permit or allow the operation of any vehicle on a highway unless it is equipped with an exhaust system of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment, in good working order and in constant operation to prevent excessive or unusual noise. An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make."

The SPT website says:
"Q. What are the sound decibel differences?
A. Noticeable increase from stock."

So, technically, it is an illegal exhaust (but I'm not a lawyer and I don't understand the law).. though I think it's a rather silly, subjective law. How did the cop know that it was louder than stock?

From the EvoM forum, someone said this:

but if you admit it is an aftermarket exhaust, that plus the officer's testimony it was loud will get you convicted.

and yes, there is nothing illegal about profiling us 'cause of the cars we drive....
we are not a protected class (age, sex, race, etc.)
Though from the story, it sounds like the judge would've found you guilty anyways..

SRT-4 Neon went off production.
SRT-4 Caliber is now in production. FYI it also has a muffler less exhaust system as well.

I own a Buell (with an aftermarket free flowing muffler), and I still think that ruling is total bull-you-know-what. I mean, you brought proof your system is legit. When I ride my bike, I sound like a NASCAR in qualifying trim, and the police don't care. If I had something like that on my WRX I'd get a ticket faster than you can say, "Pull over." Fcuk double standards!

I would've definitely brought into question the Officer's accuracy of his ear-o-meter. Somehow, I don't think Johnny-law can exactly measure what dB your car is emitting, and how that compares to VA code.

Sorry to hear about that. VA law-enforcement strikes again.

Screw that.I would find out who his supervisior is(mayor/govenor?) and write a letter explaining that you did not get fair justice and that this guy is off his rocker.If a president can be impeached,a moron judge can aleast be repremanded.Since when do judges base desicions on opinion and not facts?Oh,whoops,thats right we are in America.Long live O.J.!!

Absolutely appeal. Kangaroo court only works the first time. If you appeal, they will have to look at your evidence carefully.

Also, it is always a good thing to have another traffic court ruling overturned. (makes the kangaroo judge look bad)

Yes, Appeal. Whether or not the law says it, you were profiled due to the type of car you drive. A stock exhaust system would never be realeased if it were not legal, simply because IT CAN'T. The judge refusing to look at your evidence is absolute BS, you should take it to another level and see how you fare.

honestly its not worth it for you to appeal or go to a lawyer, but if subaru sells it it means its DOT (Department of Transportation) approved makign 110% legal.

Just because it is made doesn't make it legal. THere are plenty of parts and things for cars that are made but are definately illegal to install.

If you look at the bolded line of the law above, my interpretation is that if your muffler is louder than stock, it is illegal. It is a factory OPTION, not exactly factory that is where you might get scrooged and that OPTION is definately louder than STOCK

what's the law? Is there a decibel limit or something like that? I would think that would be your only hope in this sort of situation (maybe not now, but before the court date)

im so sick of cops showing favortism to certain cars. its the whole "made in america" bull****. i have heard these stories time and time again on the forums. if you drive a chevy, mustang, etc. then its "supposed" to be loud. but if you drive anything from asia, nope too loud, fart can exhaust, ILLEGAL! screw cops, they dont know what the h*** theyre talking about 95% of the time...

my philosophy is long as youre not driving illegally, the police should have no reason to pull you over.

Its actually a DEALER OPTION (IIRC) not a factory option, making it fall further outside of the law.

More to the point, when SOA started selling the SPT it USED to say "FOR OFF ROAD USE ONLY" on it.

Not sure if it still does, but I'm looking at it right now form back in 03, in fine print it says...

" FOR OFF ROAD USE ONLY"
