Angry Got my rear end smacked

This really sucks And to top it off its going to cost me money because this is a no fault state..what a bunch of crap.
Car can not be driven because something is rubbing in the right rear wheel.
I tried to put up some pics but the board wont let me because of my post count...getting even more pissed now...grrr

ok here are some pics I thought I would share since I have not seen any crash pisc of a B9 yet. the lady that hit me was in a 97 escort 4 door. her car was totaled for sure, the cops didnt think she had hit me but that I was a car ahead of the one she hit.




this is a pic of the right rear wheel well, somthing got pushed in far enough to rub up againt the tire.



here is one of the roof line with a nice buckle to it



I have some more if you want I can put up here.

How can it not be her fault? You were rearended. It may be no fault as far as criminal charges go, but surely her insurance would still have to pay.

It seems that the only way to get her insurance to pay per michgain state law is if the car was parked.
I have to file some form to get my 500 bucks back from her insurance company (this can take 4 to 6 weeks to get back) 500 bucks is the max allowed by state law.
I wish I had a camera phone for pics of her pos car.
my B9 is sitting at the dealer he said it would cost from 6 to 8 grand to repair.

That is one screwed up law. Seems like it protects the guilty to me.

No fault for damage? NJ is no fault for medical expenses so you are protected against the uninsured / underinsured.

Criminal charges? Like a traffic ticket?

NJ insurance companies track accidents regardless of type. THey have found that there are people who frequently get rear ended are assigning fault to those drivers.

I am a police officer in Tennessee. I am also a traffic accident reconstructionist. When we make accident reports it is a criminal investigation. We investigate the accident to see what laws were broken and note that in our report and cite or arrest the driver if needed. We may not always write a ticket, officer discretion, but we note what laws were violated. I don't understand the logic in having "no fault". Someone can hit you and, though it isn't your fault, you have to pay for your own dameged car? I can see assigning partial responsibilty if its called for, but no fault I just don't get.

I went back to the police department to check and see if a ticket was issued..NOPE. she was found to be at fault with a "hazard code of 12" this means she was folling to close or some crap. I in the process of filling a claim against state farm called a "mini tort" (sp?) which will get me back 500 bucks at the most..weee I am already out 100 more than that for the rental.
more pics to comefrom the claim adjuster later. first look at the car and its at 6g for repair. and he has not seen the whole thing yet. they still need to do more tear down.

You're allowed to file the "mini tort" claim only when you have no collision insurance. I can't believe your insurance agent (or your car loan issuer) would let you run around in a $30,000+ vehicle with $0 collision coverage.

how it works here is, you fix your own car, medical and pay your deductable. you can get back up 500.00 of your deductable only if it was not your fault.

That's how it works for people like yourself who buy only the minimum insurance required by law. But I suspect most owners of $30K+ vehicles also buy some form of collision insurance, in addition to the minimum insurance required by law.

There are three basic types of collision insurance you can buy in MI. Limited Collision pays for your repairs (minus deductible) only when the other driver is at fault, as in your case here. Standard Collision pays for your repairs (minus deductible) regardless of who is at fault. And Broad Form Coverage is like Standard except the deductible is waived if the other driver is at fault.

You really need to look into buying some collision insurance.

I have standard collision with a 500.00 deductible, (that I have to pay) this is part of whats has ticked me off..I do need to look and see how much more the broad form is going to cost.
I am use to living an area like chicago , there they have normal insurance..your fault you pay..plan and simple. this no fault crap is retarted and only protects the morons that dont know how to drive.
