German MAN manufacturer sues Chinese Firm "Zongda" over lookalike Bus

MAN Truck and Bus vice-president Franz Neundlinger said the copying was "crystal clear", showing pictures of two strikingly similar buses - one the German company's, one Zongda's A9.

He said the A9 was "an entire design copy of one of our leading coaches", adding that the case was intended to pressure the Chinese government a to crack down on illegal copying of copyrighted designs - a widespread complaint of foreign companies

"A decision not in MAN's favour will most certainly have a negative impact on the value and meaning of intellectual property rights in China," the company said.

A Beijing court took the case in September 2006 but MAN executives said there had been no response from Zongda, whose staff declined to discuss the matter when called by Reuters. A member of its legal department who gave his surname as Pan denied any knowledge of the case.

He said: "If they really have sued us, we'll certainly respond."

MAN executives said the Chinese company may have already sold hundreds of A9 buses for about a third of the usual price of a Starliner, which costs about 350 000 (about R3.3-million).

The Starliner design is not made in China but Neundlinger said pictures of it were shown at an auto show in China in 2005.

He said: "We really don't know how they did it; it seems to us they copied from pictures."

I don't think the Geman company is going to have a leg to stand on. China is going to say "Sorry but we don't see anything that can't be chalked up to creative similarites. Our bus is a great peice of equipment and competion should always be incouraged in the business world" Thank you very much for your concern, sincerly, China

dear lord that is hilarious.... they didn't even try to make them look different.... I mean change something.. change anything. But then again, this is China - MAN is probably gonna have a tough time doing anything about this. China's Intellectual Property rights enforcement is minimal at best.

Once again, I am impressed at the Chinese ability to out copy the Koreans... who were first known as the kinds of copy. sonata/accord..

Do I even need to bring up the spectra5 vs Protege 5

^ Yes, but at least there are distinctions with the Korean brand.

Show me anything distinct of what China is doing besides the paint color for this bus.

This is how most nascent industries learn... just usually it isn't done so blatantly.

Watch... if they can copy something as complex as that German bus so exactly, you better believe that they will be churning out buses and cars of their own creation - at world-class quality - sooner rather than later.

You ever heard of an SKS?

One Chinese company copied the Audi 5000 and put an ugly red flag (Hongqi) ornament. When VW sued them in court, the Chinese judges said: "This vehicle is obviously different because of its red flag ornament. Case dismissed."
