Exclamation Class Action Lawsuit Poll

ONLY POLL IF YOU HAVE HAD WARRANTY DENIAL.

So, reading about all the warranty denials from SOA for legitimate transmission failures pretty much gets my blood boiling.. My car runs fine and I don't drive her hard. Though transmission failure still happens with cars and people like me. I love my Subaru but I don't want to get the SHAFT if anything ever breaks..

Just curious and wanting to get some feedback to possibly send to SOA.. Who all would be intrested in fileing a class action lawsuit against SOA for the typical SHAFTING and warranty denial?

Do a search; lawsuits and court cases to this end have already been done or attempted, and they failed or never happened in most cases.

If you don't drive your car hard, then you have nothing to worry about. Upon teardown, whether or not you beat on your car will be plainly evident to the techs. Until that day happens, don't dump your clutch, don't try and do a four-wheel burnout, don't try to force your car into first while you're abouve 10 mph, and don't drag it. Oh, and don't mod it if you're in any way concerned about warranty denial. One thing to consider: if you bought your car used and the previous owner beat the crap out of the car, SOA is within their rights to deny warranty work where the failure is due to the driving habits of the previous owner. Good luck, have fun, and be safe.

I autocrossed my '02 WRX for 2 years before I broke 1st gear.
It was MY fault. I dumped the clutch with a new clutch and should have expected nothing different.

Point being.......what you read on here will NOT always contain ALL of the facts and while the early model WRX's were more prone to failure, it was still the result of abuse not a SOA defect.

Subaru will deny a claim if they want - check

My 02' wagon grinded when putting it into second gear, Subaru said this was normal - check

There are a fair share of people who tried the "babe in the woods" routine but were eventually found to have left out relevant information about their situation (i.e. modifications and/or past abuse). ......and those were only the ones that had a past post history for proof. As for every other complaint, you have to take the members word that they are being truthful.

I'm not saying legitimate claims/complaints do not exist. In fact, I'm sure they do. However, (as with any car forum) you must take what you read with a grain of salt and remember that you are typically hearing a one-sided view of the story.

"I was just driving along when..."

Yeah right...

And SoA hears this all the time too and when the truth is found out by either SoA or by a post check on here... Its 99% of the time NEVER a case of "I was just driving along when..."

The whole "My blood is boiling!!!" explanation of the poll led me to believe that you were going to take the results of your poll and march into a courtroom and battle Subaru with your righteous anger.

Had you done further research about transmission failures before making your useless thread, you would have discovered:

1. Failures are largely caused by improper modifications and/or improper driving styles.

2. Failures are largely reported on the 2002 and 2003 transmissions. Subaru widened the gears in 2004 and onward to the RA spec. I do not recall seeing any threads about a bone stock '04+ failure that did not involve poor driving style.

3. This place is what we like to call a "message board," which is full of anonymous people who can pretty much post whatever they want. Due to the anonymity, people tend to let their immature side show...kinda like a 2-year old who puts his hands over his eyes and says "Can't see me!" when he's caught coloring on the walls. "My car blew up. LOL IT WAS STOCK! I hate teh Subaru!" Right.

You can call people names, but we have been here forever and have seen too many people who don't do their research before posting. It's annoying, and I'm too old and tired to let my blood boil over something as asinine as making a lawsuit based upon posts I read on a message board.

Once again, it's just a poll.. I don't have time to internet argue with you.. I did my "research" I knew that transmission failures were more prevelant in 02-03, I also know that transmission failures still occur in the 04-05 models.. It's just a poll, if you don't like the poll get out of the thread..

so people that heavily modify their subarus should be able to file a class action lawsuit according to you? i dont get it. why do you have those options there?

if anything, you should only have a STOCK choice for yes, and a STOCK choice for no. otherwise, if you modify, how can you expect them to cover it? "it dont make no sense..."

From talking with people in person and reading here, it seems that in the vast majority of cases, those who were honest up front and kept their cool, got taken care of...regardless of mods. Those who got all bent out of shape, and those they knew were lying, also regardless of mods, got el shafto.

I never tried to claim it, I knew it was my fault and paid to have it fixed, and this last time i said screw it and am looking for an sti swap.

what are the grounds going to be? I would bet 99.9% of the legitimate claims get covered as they should be... probably a pretty high percentage of those that shouldn't as well...
