Default dealership trying to screw me up

i took my car in to turlock auto plaza for a 2nd gear failure on friday. no call from them, so i called them on tuesday and ask them if the tranny was cover under warranty. richard hart tells me that the tranny is under warranty and the parts are on order. remember that they never called me and order the parts already without letting me know. so i was happy that it was cover, a month goes by and i asume they would called me for updates but no calls. called them today 3/1/07 in the afternoon and ask about my car, they tell me that its done. im like wtf this dealer sucks at customer service, this wasnt the first time. i order some belts and other thing and they never called me that they've arrive. anyway i go there and pick up my car sign the recipt pay nothing walk out and went striaght to fishing. larry hobson calls me a couple hour later telling me its not cover under warranty. im like wtf, they tell me it cover and then repair the tranny and now he telling me it not cover. he then tells me that it was because of abuse and then say it cost 3500. he then tells me that because i bought the car from turlock he was going to give me a discount. i lose signal after that but im pretty sure he was gonna do something to make me pay for less.

my question is what should i do? call soa?

Do you have it in writing that it was covered under warranty? If you do not present documentation or a witness, it comes down to your word against theirs. If you picked up your car, they should have provided some sort of documentation illustrating that you did not have to pay. Their customer service leaves something to be desired, and you seem to have been very patient with their short comings.

That is completely bat**** insane. I hate bad dealerships, shame I haven't found a good suby one yet. Goodluck.

over the phone with richard, he was the one that told me. yes i have the receipt. one has all the parts list with n/c on the total. the other just stat:

73034 2nd gear test drove verified no 2nd gear trans binding removed
Trans and split case found 2nd gear on main shaft stripped of teeth and
on driven shaft dissassembled found 3rd gear syncro broken replaced
main shaft and all needle bearings and roller bearings due to
contamination and all nuts. replaced 2nd gear on driven shaft and 3rd gear syncro.cleanded case and reinstalled shaft and reassembled rest of trans reinstalled in car filled with new fluid and test drove shifts smooth trough all gears no more grindin

then it lists the five star advisor team
total $0.00

First thing to do is carefully look over any paperwork you have gotten from them. If when you picked up the care they handed you paperwork showing "NO CHARGE" or something similar then you're good. Tell them no, you don't owe them anything but, a thank you. If they put any real pressure on you, then call SOA and give them the service paperwork number. If they want you to send it to them be sure and send them & the dealer a "copy" and keep the origional. If the dealer still pushes or threatens then, use the one hour most attornies provide free to discuss the issue. Don't be intimadated by pushy-load mouth threating talk.

Looks to me like some one made a mistake, and they are trying to get you to fix it, at your expense.

If you signed the repair order when you left, and it stated no charge, you are in the clear. They can't (i don't think legally) ask you to now pay for it. I would call SOA and give them a heads up. Looks like the dealer will be eating that one.

well... sucks to be them because if you have left with your vehicle with a receipt saying $0.00 amount owed, you do not owe a thing. First off SOA doesn't warranty 2nd gear being stripped which the dealership probably just found out about. Now they want you to pay for their mistake. You don't have to, they can't force you to pay and you do not need to worry about it. They will be eating this one and any court will decide the same should this end up there.

Most Subaru dealers won't touch a broken WRX manual transmission until the owner signs an agreement to reimburse the dealer for any work done if SOA disallows the warranty claim. If the original poster signed such an agreement, he'd better pay up.

So you signed the paperwork and the total was $0?

Then the dealer can't do anything. They obviously did the work without authorization from SOA, and the service manager didnt realize it until after it was all done with.

Check with your states BAR and see what it says, but i'm fairly certain they cant legally ask for any money at this point.

well when i got there i told about my 2nd gear, all i really sign was a $99 inspection. after that everything went from them not calling me to me calling them about my tranny. they told me its cover and parts are order. they didnt have me sign anything after that. i called in and they said the car is ready to be pick up. i got there and sign a reciept 2 pages long total is $0.00. lady gives me keys and that was all. what i was thinking that isnt soa suppose to send someone to check it out before the dealership went on ordering parts without letting me know until i called? what is SOA # may i please have

pretty much how i see is dealership f-up and trying to make me pay for it but at a discount price for buying car there and a customer. <---told by advisor.

In alot of states, legally, repair shops have to inform you of the total cost before doing the work. In other words, if they didn't tell you it would cost 3500$ you are probably clear. Check your local laws.

Since you only authorized a $100 inspection, that is all you could have to pay. They did the other work without authorization. But since you have a $0 receipt, you are really free.

Did you actually authorize anything to be done to your car? What exactly did you tell them they could do?

Here's the best answer....

Take all paperwork you have to a " Notary Public" and get them certified as "True Copies" before sending them to anybody. This way they can't say you made it up and they will not be able to switch them on you.
I would also contact SOA and get a case # and send them the paperwork instead of the dealer. Tell the dealer if they contact you that SOA will be looking into it.
This wiil do a couple of things;
1) It will let SOA straighten the mess out
2) It will tell SOA what a poor dealership this is and make some changes to it

the only thing i authorize was the $99 inspection. after that they did everything themself without me knowing until i called.
