Default Should P1443 ECU Reflash be covered under Emissions warranty?

Hey, my car is at the dealer so I don't have my paperwork in-hand to study. I just logged a P1443 CEL for the first time in almost 6 years (first time was 7/2001, back before the ECU reflash was identified as a fix for this code).

Now that I'm 3 months off my extended warranty, of course it throws the code again and now the stealership wants to charge me $142.50 for the ECU reflash!

I'm of the opinion that since this is an emissions related code, it shold at least be covered by either the state or federal emissions warranty (7 or 8 years, respectively). The blurb for the Fed warranty on my.subaru.com even says "Some specific major emissions control components (catalytic converter, electronic emissions control unit and the onboard emissions diagnostic device) are covered by the Federal Emissions Defect Warranty for a period of 8 years or 80,000 miles, whichever comes first. ", so it seems like it should be covered.

Anyone else have a car old enough to be off warranty that's gone through this yet?

I'd like to get the fix, but there's no way I'm paying for it. If they insist on charging me, I'll tell 'em to sod off, and just clear the code myself and hope it never pops up during a SMOG test (unlikely).

That's what I would have thought, except they say "no". I've printed out the little blurb from the Warranty section of my.subaru.com, but I'm hoping I've got better documentation with my warranty paperwork in my glovebox...

It's also important to realize that you might have a legitimate P1443, one that's not due to an ECM miscalibration.

They've already ruled that out. The car's been in their posession for 2 days and their conclusion is that it needs (and only needs) a reflash.

You could also ask, in your local forum, whether someone with a Tactrix cable would be willing to reflash your ECU with SOA's latest 2002 WRX ROM image.
