Default NJ homeowner, especialy somerset area. i need your help!

Hey guys/gals!

couple of month i ago i received a ticket for having disrepair/unregister vehicles on my property. i have total of 3 cars.. 89 RX7(disrepair), corolla(unregister), and my just purchase L(unregister). So i went and tow the RX7 away..register the corolla and inspected and i relocated the L for now. Ok .. well then my RS engine blew.. so i didnt want to leave it in the driveway so i park it in my backyard for now until i have money to fix it. But i just received a summon saying that i have a disrepair vehicle on my property!! ITS IN MY FREAKIN BACKYARD!! Are the township people even allow to step on my property...like go around the back and check what is behind the house? well i dont have a fence or anything..

any lawyers here want to enlighten me on this matter? What rights do i have?

i just posted up a private property sign but i posted after i got the summon...


please i need all the help i can.. this is a pretty big fine i heard!

Sound like you need to buy your neighbors some beer! Some area, townships, neighborhoods have certain rules about that kind of stuff. Do you have a list of indentures that you could refer to? GL

its likely that someone is calling to complain. i could be wrong but, i dont think those guys would just walk in your backyard and see what you got back there. put up a 6ft privacy fence

This is an issue dealing with a local ordinance, so your rights vary depending on the town. Anyway, if the vehicle is not within plain view from the street, then one of your neighbors is not playing nice!

Put a storage tent or a plastic enclosure into your backyard and hide your cars in there. You can put a lock on the front. If they can't see it they can't do **** about it.

Some towns will require a permit and have guidelines/restrictions for such "tents", if they are deemed as being used in a non-temporary manner.

I suggest that you don't make this more complicated than what it is. Call your local code enforcement office, and ask to speak to the person that issued the summons. In 99% of cases, they will provide you guidance on how to remedy the situation and avoid any further violations.

i was thinking about the tent/canopy.. but yea it needs a permit

and nope it is not in plain view, unless someone goes behind my house, then they cant see it. so u say township officials can just come into my backyard and i cant do anything about it?

time for some sniper camo covers for the car... we can cover it and no one shall know it lives there ha

and although you have private property up i think like government / state officials are allowed on your property if they are like researching a complaint. But as somsone said if the thing is locked in a tent they can not legally open or look in it

yes the township does have the right to look at your yard...if its not fenced in...beleive it or not the township could even issue you a summons if your yawn is not mowed and yes even the back yard..if its not fenced in..they say your bringing down value of the neighborhood...i know it sucks...if you get a privacy fence then its not in view of the neighborhood...problem solved.

since they know its there.. and local ordinace does say no disrepair vehicle on property.

I think it's too late at this point. Also your neighbor could allow them on their property and they could look over the fence IIRC. As you said they know it's there now, so they can come back to inspect to make sure you got rid of it. Some counties in NY don't allow un-registered cars even on the driveway. Your best bet would be to make sure the car is registered. Then get a bunch of gravel and make your driveway extend into the back yard. Then it's just parked on your driveway, the fact that it's in "disrepair" is irrelevent since it'll be registered and just not driven.

leave your car on the neighbor's yard and call them in for a summons. That would backfire very badly and you dont even know who it was, so nevermind.

Yeah, so figure out which one, and report them for EVERY little thing they do "wrong". Do your best to make their already miserable life (if it wasn't they wouldn't be petty like this) completely unbearable.

well i just emailed the zoning inspector. I doubt she do anything to remedy my situation. but its a try. i have to see tomorrow. I still cant believe they can just come into my backyard!!! i should have dog back there!!!

bah email is pointless, always call..its much more formal specially if you are tryin to reason with them that you are in action reo repair said car etc etc

and if your dog drops a deuce and you dont pick it up you can receive tickets for that and i dont think you want anymore of those

it sounds like your best bet at this point is to relocate the car temporarily. after all the inspections are done, that's when you get a tent. whether the township can or cannot look in your backyard at this point legally is a mute point. they WILL come back and look. relocate, talk to the townhsip and get it resolved, then put up the tent.

also- i know this probably sounds stupid and you may have already tried it, but what about parking it on the street for now?

hmm it has to be inspected right to park on the street

it doesnt run, i mean it is registered and still insured.. but not inspected

even if it sat on the street for a prolong period of time im sure theyll say something about it.. sounds like you need to get a lawnmower and some tow straps and move this thing like everyday ha

but in honesty i would talk to the zoning people ask them what can be done, and you do plan on repairing the vehicle shortly you are just souring parts for this... im guessing you have no garage to put the car in?
