I spoke with shawn. and the insurance company trying to play games..
saying it was no one's fault.. meaning he has to pay the $500 Deductable..

I can't help much unfortunatly, I didn't see it happen, just the aftermath..

but if any of you did.. please e-mail the person the in the refernced post.. it would mean alot to me.. and more to shawn..

Hey guys. I got the assessment today on my car. The guy looked at my
car, decided what needed to be fixed and what needed to be replaced,
went into his car and left the results on my car while I waited in my
apartment.

When the guy left, I found a computer print-out of the assessment, a
list of body shops in MA, and a check for $1200. After reading the list
of things to be fixed on the car, I found that my deductable from MY
policy had been taken out ($500) of the assessment. The damages came to
just a lil under $1800.

After calling my insurance company about this, they told me that b/c it
had not been decided who was at fault, they were only giving me what my
own insurance company would give me, and if I was found 50% or less at
fault, I would be given the other $500 later.

This is my first wreck in MA, and my experience in AR was quite
different. I didn't expect a check to be left on my car for one. I would
assume that this means that I have "settled" my claim, in which case I
have not. Am I only committed to the settlement if I use the money
toward the car, or is everything a "done deal" now?

Also, if anyone can send me information on the body shop that they
prefer here in MA or NH, please do. I would prefer someone who does a
good job, but who will work with me on somethings that I want done to
the car.

If anyone thinks that I need some legal counsil, and also has a
suggestion on who to goto, I would appreciate that as well. I feel like
I'm getting screwed here.

Seth, I know you took pictures of the accident, so if you could please
e-mail those pictures to me, that would help out a lot. Those pictures
might be what saves my ass in this deal.

Fish or Dave, could you please send me the URL to the Impreza BB so that
I can try to find some witnesses? I don't know if anyone has spoken on
my behalf, but from what I can gather from my insurance company, no one
has. I heard a lot of stories of what happened, so someone must have
seen it.

Sorry about the long post guys, but it seems like if you give these
insurance guys the benifit of the doubt, they try to screw you anyways.
It's like they want me to go get a lawyer and go after them for more
money....
