Default Need help on what to do in this situation

Last september i bought a wrx from a member IcedearthWRX on here to use the swap for my brothers gc8.
http://forums.nasioc.com/forums/show....php?t=1352334

Before i started pulling the car apart i drove it around my area for awhile to make sure everything worked good especially the trans. Went thru all the gears and felt good. I started to part out the car and was gonna use the trans with the motor but made a couple threads and was told that the rs tranny i had would probably hold up better so i sold it to member bakodabro because his trans was broken in his 03.

So i sell him the trans in sept. and today he texts me and says the trans is beat he just put it in i guess and said was making noises. I asked him what kind of noises etc. and what kind of fluid he used. I didnt't hear back from him until i get another trext saying its f***ed and he lost 2 gears. I don't know what to believe Rob that i bought it from said it was fine, i drove it around and it seemed good. But now its blown apparently. I haven't been in this type if situation before and don't want to be a bad person because i am not but i don't know if this kid is playing with me and has had it in for awhile and blew it or what not. Also the other problem is i have been out of work and have no cash at the moment to give him and take back the trans. What would you guys do in this situation?

Tell him AS-is...and that's it.Not to sound like a jerk, but u tested it and felt like it was a good tranny and felt honest about selling it.

That's a good point. I am just a nice person and always try to make everyone happy. I contacted the original owner on here to get confirmation for the guy i sold it to to say it was in good working condition. But since its been over 2 months and i know it was good when i drove it has me questioning the situation. If he would of called a week later and said hey its not working right i had the cash then and i would of definitely taken it back. But right now with the economy and such is just bad timing also.

ahh i'm so stressed right now, other factors that have me thinking is what type of fluid did he use and how much. When i sold him the trans it was completely drained so i hope he would of put fluid in. The car i bought had 37k miles on it and was bone stock pretty much for a bolt on muffler and turbo timer and boost controller. It was fine when i drove it and now it lost 2 gears?? doesn't make sense to me. I keep asking him what fluid he used, how much and what gears went but he hasn't told me yet.

How in the hell were you able to test drive that pile of junk is my question? From the pics it looks beat to hell. I doubt you could fully test the car in that condition. Driving around the block at 10mph doesnt count...IMO the transmission had issues from the beginning.

Yeah it looked like crap but it ran and drove fine, the back driver's side wheel control arms were slightly bent and i straighten them and drove it. Yes i didn't get it to redline in fourth and fifth but it felt good.

If he contacted you right away then I could see giving him his money back. But 2 months later...I don think so. I wouldn't believe any of it. If you felt it was a good and make and honest sale then there isn't really anything you can do. If he didn't put fluids in it...wow thats all on him.

after two months, I would not take it back. He's got no proof that he did not use it for those two months. Plus, he should know that there is a risk of buying a used tranny.

this is the same stuff going thru my mind, i told him i find it hard to believe and he said his car sat since sept and he started the trans 2 weeks ago, tuned his car and went for his first drive. He said it ran good and then began to not shift into gears and he would only have first and second. So he thought it was the clutch a so he pulled it and the throwout bearing was bad, so he put the trans back in today and and the same thing. Said he drained the oil and there was metal shavings(which you will find in any trans) and he put 30 miles on it.

This is direct from the texts im getting. I don't understand how he tuned his car without going thru the gears. I don't know what kind of power he is making but something has got to be up if he blew his first trans up. Second he said it was fine then started to mess up down the road which if it was bad to begin with it would of been crappy from the start and i know it was good.

I knew the trans was good and by what he just told me it seems he did something wrong installing it or is pushing too much power for a stock trans.

Tell him that there is nothing you can do for him. It was good when you had it. Thats all that matters.

You sound like an upstanding kind of person who didn't intend to screw the buyer on this one.

Honestly, he bought it 2 months ago. Which means he has had PLENTY of time to install it and run it into the ground. And as mentioned above, I don't see how he could come up with any proof to show that he hasn't been using it for the past 2 months.

He is SOL if you ask me. And it is not your fault in the least bit.

Worst case, even if he takes it to court, I don't see how he could win the case with the situation as it is. I would tell him you're sorry, you sold him what you understood to be a good transmission and there is nothing you can do.

^^^ thanks alot dude this is how i have always been towards people

I keep telling him i don't believe it and that it has to do with me but he still thinks it my fault . He said it whining which usually means a bearing and it didn't do it at first? I checked the main shaft bearing when i pulled it and it spun fine and had no play so idk what went wrong in the two months he has had the trans. He was a cool dude but by the way he told me the story it looks like he did something and is trying to blame me.

At this point I would honestly just start ignoring him.

He is not going to stop bugging you until he gets you to do something. Just block/screen his calls and leave it at that. You've done nothing wrong that I can see.

He is texting me over the phone i wish it was on here so he could chime in and i could copy and paste what he says cuz my hands are getting tired lol. He texted me again when i asked what is wrong with the trans and why did his first one go. He used an openport 2.0 cable w an xpt 2.5 tuning map with a td05h turbo gm bcs ect. I am new to suby tuning(came from honda's and other cars) but whats a gm and bcs? I am assuming he donwloaded a tune that was setup for those mods, i think of tuning as to going on a dyno and doing some pulls and tuning and tweaking things so i guess he didn't drive it when it was tuned.

ok this is the last text he sent me when i asked what was wrong with the trans since he never gave me a true answer.

He said: It makes bad whining noise clunking rattling. I can begin to shift thru gears and 3rd 4th and 5th are tough to get in and then all of a sudden i wont be able to shift into any gears and will be stuck and have to come to a stop and then ill get it into gear again but its a rough ride you can feel it bucking and stuff you can feel it man.

I said the only way he would feel bucking and stuff is if his clutch was slipping, a bad tune or if a gear was completely gone and catching here and there but he would of had chunks of metal coming out when he drained the oil.

What does this problem sound like to you? I am trying to sit here and listen to him to help him out but idk what the hell going on with it lol. All i know is was good when i sold it bottom line. But if you guys know what may be wrong with it or his car let me know please.

You are under no obligation imo. Transmissions are like half the transmission, and half the quality of the install. Transmissions fail quite easily when the work is not done properly, and that doesn't necessarily necessitate the transmission being opened either. Plus, given the length of time between when you sold it to him and when you heard back from him, I wouldn't waste my time on it.

Yeah i know i have seen kids put a quart of oil in and burn out a main bearing in 5 miles, i don't know what he did or what not. He said the throwout bearing was bad but thats a cheap object i replace every time i pull a trans no matter if its bad or not its just cheap insurance.

He doesn't know much about it he said or trannies he wants me to speak to his friend tomorrow that he helped put it in. So i will have some updates tomorrow after i speak to him i guess.

Thanks for all your opinions and help, i am nice guy and always helping people out to the point where people walk all over me and play guilt trips so i am easily wound into stuff like this. My close friends and gf hate the fact i am so nice and let **** happen to me but w/e.

Buying used parts has its risks. Everyone knows this. Even if you buy from a junkyard they'll give you 30 days at most and you'll never get your money back! You didn't have anything in writing that you guaranteed the trans would be good did you? He's really SOL if you ask me. The sale is done and thats the end of your obligation really.

the guy already broke one tranny, chances are he broke this one too. He is most likely doing something stupid and its def not your fault.
