The incident began at about 3:29 p.m. when police received a call from a woman walking in the 500 block of Winsor Street that she heard screams coming from a house, police say.

A police officer responding to the home asked the resident if anything was wrong. The man said he was screaming because he was playing video games on his television, police said.

The man then became irrational, prompting two more police officers to respond, police said.

After the officers arrived, the man continued to become more and more irate, refused to let the officers into the house, threatened the officers, then slammed the door, police said.

As the officers continued to communicate with the man through open windows, the SWAT team was called and staged in the nearby parking lot of Bound Brook High School.

The man decided to come out of the house without incident at 4:41 p.m.

I was going to make a crack about Somerset County richies and how there probably isn't an Xbox for miles, but then I read Bound Brook.

wait,

whats the law on this one. Lets assume a non irrate/crazy person for this discussion.

If the cops come to your house, for a complaint of one kind or another, do you have to leave your house? Do they have to have a warrant or something?

For this fellow in particular, if he had refused to come out, for what was a noise complaint, would the police have been justified to use SWAT to arrest him?

Seems a bit much.

I don't understand what the guy did wrong? He was loud, the police were called and wanted to know if he was okay, he said he was playing games and told them to go away. So they call in swat?

On a hunch, I'd say this is the foundation of their justification.

What right do these cops have to be allowed into the house?

They can ASK to enter the premises, but they don't have the legal authority to just go into a place - at least not for any reasons that were written up in this article.

And what do they mean by "irrational"?... I mean I would be more than a little pissed if some cops were called on me for playing videogames... would that be perceived as being "irrational"?

Judgment call. They will claim they believed at the time of the incident that he may have been a danger to himself or others.

He was probably drunk and a belligerent one at that.

As usual, the media has portrayed someone as guilty until proven innocent, biasing the article entirely in favor of police officers.

The sad thing is how easily most of us can see police aggravating the situation just because they don't like someone..
