Default should i fight it or take the fine

so thursday i was driving down sr-92 by the smiths and micron in lehi and i was heading west and right after you pass the light that leads up to micron it goes to a two lain road for about 500 years or so, the car in front of me was doing about 35 on a 55 mph road so i passed 2 cars on that road not even going over 60mph easy pass then i got pulled over but one of the cars that was a retired detective he called lehi police on me and told them that i was under the influence of drugs. they made me to a sobriaty test they also brought in a drug dog that scracted the side of my suby broke my glove box and scratched the screen on my gps system and they found NOTHING!!! and i recived a reckless driving ticket do you think i should fight it becuase it doesnt say anything about no passing

yeah im thinking about it if i get another ticket i get my license taken away until august 30th which isnt that far but i have places to go school/work

for one they shouldn't have searched your vehicle for drugs unless you seemed under the influence when they pulled you over, and two they shouldnt have even pulled you over until they saw you driving recklessly, most cops never go on word they have to see you break the law for speeding and other driving infractions to give you a ticket. 3 the prick that did call you in probably is on this domestic kick and wanted to be a douche bag because you drove an import and supposedly hurting the American economy.....at least some people talk crap about why I drive an import and that its people like me thats driving the economy down and forced GM to go bankrupt. I hate how people think they know what is going on but are way off on some wild tangent.

one of the lehi officers said i should fight it i thought it was kinda funny there were acutally really nice and commented me on my car after they found no drugs

yeah theres deffinety a couple hundred dollars worth of damage to my car and yeah im just like way stressed out about it because if i loose my license im fu**ed

The only downside to fighting it, is they will look at your record and see that you are just a few points from having your license suspended. If you had no points I would believe that they would take the matter more seriously. You should fight it for the fact that they didn't have probable cause to search your car especially after you completed and passed a sobriety test. If I were you I would fight it, I ended up with my license suspended for 2 years because I failed to fight ridiculous charges. I was actually charged with a DUI even though I completed the field sobriety tests and had them take a blood test which came back negative for everything. I was just too stupid to fight it and took the consequences. IMO Fight it to the end, if you cannot afford a decent lawyer(Look up Fred Meadows, and or Earl Xais they are around $3,500, but the best), then I say try your luck with a public defender. I know all too well about the abuse of power of some police officers. If you need numbers and such I have a few numbers of good lawyers, so feel free to send me a PM, and good luck with everything, I hate to see this kind of crap! I hope they at least pay for the damages they inflicted to your car.

stories like this make me thankful my mp3 player comes with an audio recorder. If i ever get pulled over, first thing i'm doing is hitting the 'record' button, in case they try to pull crap like this on me.

Pre-paid legal is the way to go. Its not that expensive and the lawyers take good care of you.

Talk to a lawyer for sure buddy! Fight the ticket and get them for the damage done to your things. You can't do anything about the guy who called it in...I know because my buddy is a cop and I just spoke with him about your situation.

We don't know that. A sobriety test is not the only measure for whether or not an officer can legally search a vehicle during a traffic stop. Also, if the officer simply asked if he could take a look and the OP said "okay" there's no case.

You can always fight the ticket, whether it will do any good is a different story. However, I would deffinitely look into your options as far as the damage to your vehicle. It is one thing for the officer to search the car if he has probable cause, but just because he has PC to search the vehicle does not give them the right to cause that much damage.

I would definitely talk to a lawyer and see what options you have, and the likely hood that you have a decent case on either of these though.

There is a lawer on 94.9 in the morning on mondays at 7:30.He always say to call him if you need a little bit of free advice.If I was you I would try to listen tomorrow and get his number and give him a call atleast see what he says.

Fight it like crazy. That is retarded, and they did not have justification for it at all. And the recording of audio is a great idea. From now on, any time I get pulled over, I am gonna let the officer know that my phone is on and recording the conversation for legal purposes. Just so he is aware, whether it really is on or not....

I hate these types of threads because we don't know if the officer had justification or not. We only have the OP's side of this story. There very well may have been probable cause for the search.
