Angry My car is NOT what I was told!

ARRRGGGHHH! I got a really unpleasant surprize today. Now what do I do?

When I purchased my used 1995 Impreza L in Feb of 2001, the dealer had just taken it in off a trade the day before - hence it had no window sticker. At the time, the salesperson told me it was a 2.2L with AWD. I was much less knowledgable about the Subies at the time mind you, so I would not have know where to verify this info. Hence begins my problem...

Imagine my anger when I happened to go out to replace my headlamp this week and happened to be looking at the placard in the inside of the hood only to see the engine type EJ18!!!!!! I was hoping it was a terrible mistake, but I had a Somers Subaru look up the VIN and they confirmed it is a 1.8L.

I called Don Jacobs Subaru who sold me the vehicle and they refused to do anything!!! They said that on the Wisconsin Dealer info (the window sticker) it said 1.8.
Ok... so basically I was lied to and got screwed. There's nothing I can do about it now since I signed the Wisconsin Dealer info. I even asked the dealer at the time of signing about the 1.8 on the info, but he said that was a typo!!!!! A$$HOLE! They offered nothing to make it up to me either... I feel so stupid to have believed him.

So what recourse do I really have? I guess file a complaint with BBB and SOA? Anything else?

I'm so angry I'm shaking and so sad I could cry. I'm so dissappointed...

Don't buy anything from Don Jacobs in Milwaukee! They are not a reputable dealer!:monkey:

.... I know. I'm a complete idiot. The sad part I am not a "dumb" person. I thought I asked all the right questions... my husband also remembers the sales rep telling us on MULTIPLE occasions that is "had the bigger engine".

I hate dealers. Never believe them!

just a better reason to buy an STI front clip and call it a day but I am sorry about what happen. I would go back to them. tell them that you were lied to and that you would like this to be handeled in a approperate matter before you go to the BBB and SOA

I agree with you and this totally sucks that you got screwed. I also think that they should do something for you but, on the other hand... are you happy with the car and its power? When you test drove it and thought it was a 2.2L were you satisfied or did you think it was slow?

I did talk to Mike the used car manager before going to SOA and BBB - they refused to do anything to make me feel better. Jerks...

I was happy with it when I first drove it - of course I had been drving an 87 plymouth sedan, so it wasn't hard to be happy with ANYTHING else! Of course though, as I've been driving it more my one complaint has been the lack of low end power... guess now I know why. *sigh* I know there is nothing I can do but warn any unsuspecting victims.

Thanks guys for cheering me up again. I only hope I can reclaim my initial Subie elation...

Here's what I wrote to SOA:
Dear Sir or Madame:

I am writing you to lodge a complaint about Don Jacobs Subaru in Waukesha, Wisconsin.

When I purchased my used 1995 Impreza L in Feb of 2001, the dealer had just taken it in off a trade the day before - hence it had no window sticker. At the time, the salesperson, Robert Fonteine told me it was a 2.2L with AWD. On several occasions when discussing the sale, he mentioned that it was better than the 1.8L Impreza because of the bigger 2.2L engine and AWD. I am a decently knowledgable person when it comes to cars, so I knew what he was talking about.

I purchased the car on February 13th 2001 for $8,595.00.

I joined the North American Impreza Owners Club online after I purchase my vehicle - www.i-club.com and started learning a lot more about my car and other Subarus.

I really wanted to notify you of the unethical practices of this dealer. You have a great product, but their practices give it a bad name and will alienate your customers - especially those like me who are first-time Subaru owners. There are plenty of other good and reputable dealers out there that can do better justice to the Subaru brand - I think you should seriously reconsider allowing Don Jacobs to sell your product.

Dr. Nick - I don't even performance parts can make me feel better right now. Maybe in a few days....

My hubby is so sweet. He looked up the power window/locks/keyless entry/remote start parts for my car and wants to install them to cheer me up.

What would really cheer me up now is the bigger engine I was told I had....

Oh well. I guess I'll get over it eventually.

Oh come on. Granted it sucks to be mislead like that, but have you been unhappy with the car? I mean, if you hadn't enjoyed the car all along, that would be one thing (but then why would you have purchased it in the first place?). I'm assuming you like(d) the car before. I fail to see why this revelation should sour your enjoyment of the vehicle.

that really really really really really sux. i am sooo pissed right now and it's not even my car. i don't care how happy you are with it right now, kinda hard to compare now with something you don't have. i'd drive around with a sign in my car stating how crappy the dealer is (we did this with our neon and garnered some satisfaction), kinda like those truth commercials about cigarettes. feel badd for you, sorry.

Ok... I guess you're right. I shouldn't let this sour my love for my car. Deep down I really do love my car, but I guess I'm just still very upset. Hopefully my dissapointment will fade and I can be back to just loving my car again.

Maybe I'll go take a spirited drive and remind myself that I LIKE my car.

Sorry to mope. Sometimes you guys have a way of putting things into perspective. You're right. This shouldn't spoil my love for my car.

Edit: Hmmmm... that spirited drive would likely be a lot more fulfilling with a big sign that says "DON'T BUY SUBARUS FROM DON JACOBS" on the back.... hee ehh Thanks - that made me smile.

I'm so sorry to hear about that Michelle. When I bought my last car, the mofo misled me. He's like "only small fix...will not cost much..." I ended up chuckin more than I paid for it into the peice of dung.


Hey, I'd give you my 2.2 if someone will donate a 2.5 or 2.0 turbo to me!!!

Hey the 1.8L isnt THAT bad! How much did you pay again?? and what options. 8500? almost looks like you paid for the bigger engine too. I paid alittle over 6,000 for my 95 1.8L from a private seller a year ago. it was about right. You bought from a dealer so its going to be a bit higher. I just hope they didnt sell you the car for the price of a more expensive 2.2L. If so then you may have some leagl leverage there. anyway, that totally sucks. And yes it may be slow but its still a ton of fun to drive and youve got a realy nice car regardless of what engine it has

My parents bought some expensive roses from a flower shop a while ago. Unfortunately the next day, they died. When they went back to the shop the owners basically told them tough *****. SOOOOOO, they had a HUGE vinyl sign made that said I got ripped off by such and such and put it on the back of their 58 Ford pick-up. They would drive around with it and sometimes park it in front of the flower shop. Needless to say the flower people became more reasonable....

Gives new meaning to the term "Buyer Beware".

Hndatch has already looked into swapping an EJ25 into a 1.8 for one of the locals here. I believe he found it an expensive deal. Mainly because it was an automatic and the EJ25 does not bolt up to it.

If it gives you any comfort, SOA reps do read these forums for marketing purposes.

Oh at least follow him home and find out where he lives and inflict 3 times the amount of damage he did to you, to his home.

Default Paid for the EJ22

Yeah Hawk - the worst part is I PAID for the EJ22. The price of the car was OK if it had the 2.2L in it. It's NOT since it has the 1.8L. I looked at Blue Book and the price of the car when I bought it and it was acceptable - BASED ON the car having the 2.2. But since it doesn't....

I filed a complaint with the BBB. For desired outcome I said I want the price difference refunded for the difference between the EJ18 and the EJ22 per the factory invoice. So if the "upgrade" to the EJ22 was say, $500 on the factory invoice, then I want that back. I may not see a thing, but I figured hey, ya don't know until you try.

Maybe I'll park outside the dealership with the big sign on it. Or maybe hand out flyers...?

I am NOT going to let these A$$holes get away with screwing people! They definately messed with the WRONG lady!

He He - well, I don't think I'd go THAT far! I'm not a violent person. But I will make a point of letting EVERYONE know what smarmy bastards they are! If you all want to go with me I wouldn't turn ya down!

Thanks for sticking up for me - you guys ('n gals) are the best. I really hope I get some recourse via SOA or the BBB. The salesman really went out of the way to be decietful. They didn't even show me the Wisconsin Dealer Disclosure (window sticker) until SAT DOWN and was signing the paperwork - so they counted on catching me when I wasn't taking time to think things through or question things. This is just really smarmy and low. I mean, most people don't check the tags on the underside of the hood - who would ever think they have to? Geez - this dealer has really sunk to a new low. I am still in disbelief!

I was thinking I will be handing flyers out at the Schlossman's Honda Car Show telling people about my experience. Hey, it's a start.

Caveat Emptor my friends. Caveat Emptor.

And remember: The pen is mightier than the sword. Especially when wielded by ME! There's a reason my college prof said I should be a lawyer!

PssssT! She meant that as in the basis of a court room apperance. Mental anguish can award you above and beyond the actual monatary losses.

If you put a sign on your car or hand out fliers, don't put anything "bad" on there. If you handed out the flyers with your story on it simular to your letter above, MAKE SURE you take "they lied" out of it, put something along the lines of misinformed, people will figure out that easy enough. You could end up being the one sued for slander. I would call a lawyer. If you have a case, delete all your posts here. Infact I would ask Nick to delete the thread.

Its not just car dealerships, you need to be wary of signing ANYTHING that is different than what you have been told. Loan papers, leases, release forms ect ect, If it doesn't say on the paper what it should, don't sign it until it is changed.
