Default fighting a speeding ticket

i just got a ticket for 9 over in a 30 mph zone but he said i was doing 43. i am currently on probation and i need to fight this ticket. the deal is i was not even speeding. i was actually going under the speed limit bc the road was so bumpy and rutted that i was bottoming out. he also gave me a warning for my exhaust. is there any way i could get out of this since i wasnt really speeding. what do they need to prove to make me guilty and what do i have to prove to make me innocent. i need all the help i can get! thanks

sadly in more cases then none, if you fight it and the cop shows up to court, theyll side with them. Where was this at and was it actually a cop from that area and not like a provo cop giving you a ticket?

it was in clinton

i couldnt tell where the cop was from. im assuming that was his area bc he was parked waiting with all his lights off in front of a church.

wilson, was it a state trooper in a white charger? don't have my ticket on my but i got a bogus 9 over recently too, but in provo, i'm fighting it, he also said i was doing 50, but that he didn't have it on radar, so i'm trying to pull the recording from the car(most newer cars have a mic on the officer and hidden in the back of the car, to record stuff like that.

no it was a black and white ford i think. it was hard to tell bc he was sitting with all his lights off.

says i get off probation 12 08 09 =/

Did he get you on radar lance? If he has physical proof, I wouldn't even waste your time. If he didn't get you on radar or anything and it's his word against your word, you will have a little better chance but still not the greatest.

When my bro would fight a ticket the cop wouldnt show up.
My bro would win.

Just fight it and see if he shows.
Your exhaust is pretty loud. lol

I don't even get my license back until Jan of 2011... Do everything you can to fight it. I had no luck fighting mine, and they hit me with everything they could.

i lost it for 2 months last year. ive been on probation ever since (1 year) i really cant afford to loose it again

Yeah, I would research that, but even if you find that he is supposed to have lights on. Its his word against yours. And if you are already on probation they will probably take his word. Just hope he doesn't show when it goes to court. GL man, I know all too well how much this sucks!

buts its Clinton and im sure he will show. When I went to court there for my ticket earlier this year that judge was a dick. He doesnt believe in traffic school, wtf man. Only thing that would be good is if you fight it, you could possibly be able to postpone it from hitting your record til after you end of probation date

ok...I don't know how true this is but someone told me if you get a speeding ticket for say $50 don't fight it....mail in the money but pay a few dollars over so give them $57 they will then have to mail you a refund check for over paying. DO NOT CASH the check because that will close out the ticket....by not cashing it you leave it as an open invoice and they can't do anything until the check is cashed.

I've never tried it but curious if anyone has ever heard of this before.

i got a ticket on i84 coming from pc once. i went to court for it, no buding. the guys down there are huge a holes.

I tried this on my last ticket, it was about 2 months ago around Wells, Nevada coming back from SLC. I have not heard anything from the courts and it has not hit my record yet.

It may be worth a shot!

imo: get a lawyer to consult and figure out your options, what is a legal fee compared to losing your license, the increase in your insurance premium and the ticket fee itself?

Utah has anti-entrapment laws, he was required to have his parking lights on and be visable to the drivers on the road (ie: not hidding behind several large trees), Alaska has very similar laws. Im trying to find the exact excerpt stating this... Guess thats the nice part about conservative states, a few more loop holes in the legal system...

It may cost you a bit, but look into a lawyer. When I lived in Washington State we used to hire a lawyer for about 300 bucks to fight the tickets. It's cheaper in the long run. I beat every ticket I got and left with a clean record. Had a friend that beat a ticket for driving in the HOV lane!! After he won the state put up signs every 200 yards on a ten mile stretch , so no one else could win again.

Lance said that the cop was in a church parking lot. To me thats not hiding at all. Also, im sure he had side markers on but im sure that wont matter if it goes to court. I say plea in abyence

lance, fight the ticket and in court you need to ask the cop two questions:
1. " are you certified and trained to properly use and opperate the radar detector, and does he have any paper work to prove that"
2. " when was the last time he had his radar detector calabrated< and does he have prove of that"

It will work for you like it worked for me when I got a 37 over ticket in draper.

It will only work for a while, a check has a 90 day wait period and if it is not cash in 90 day then it is void. so they just have to wait it out. Then it hits your record and they get thier money back.

you should have asked him where was he parked whenhe caught you with the radar gun. Maybe there was another car passing by whenhe got you.
