Default P0021 Code even with my AVCS disabled?

Should I be getting the P0021 code even if my AVCS is disabled? What do I have to do to remedy the situation?

I have searched but I was unable to find anyone with their AVCS disabled like in my situation.

I have a 2005 WRX wagon w/ an 07 STi engine. It was built w/ the 05 WRX ecu so the AVCS was disabled so the ECU could remain.

I turned my car on at lunch time right when I was going to get an oil change and the CEL popped up. They read the code for me at the oil change shop and erased it.

I will answer all questions you guys have that can help fix this situation.
