Default Manassas B.K. Bites it!

after nearly two months of being out of commission and stuck either inside the hospital or my own house i decided to get out and check on the scene in manassas. first problem was the whole parking lot was blocked off for only pre-1978 cars, so we had to park on the side lot. second problem was the abcense of any imports or late model muscle, although i enjoy the oldies too i really wanted to see some of my friends in thier imports. no sooner did some of the import crowd start showing up and the oldies crowd start going home to bed the police showed up to chase everyone off. they started pulling poeple for anything and everything imaginable and told us that if we werent eating in the burger king that we would be arrested for loitering. we were also told that the management had closed the parking lot to anyone not eating in his restaurant. funny i thought that this place welcomed all of us as automotive enthusiasts. by the time i had gotten back to my car and ready to leave there were no less than six police cars in the lot, with officers on foot with ticket books in hand ready to start writing. while i had already begun to feel harrassed months ago i really felt this time that it was beginning to become a huge reality that the police are now spotlighting import enthusiasts with such determination that it maybe at the point of discrimination or somehow violating our rights as citizens of this free country.

you show no love for My friend and I rollin up in 2 suby's? plus there was another WRX there...

Glad to see you are doing even a little better though... i hope you are back on your feet tearin' up rt211 in no time bud... get well soon...

I can't tell you for sure what time that Rhdude, Beerheart and myself were there but it was 10:00ish.

Before I discuss what happened there let me give you the prelude to our arriving there: We had first met up at the Dulles Town Center for our regular Friday night meeting and attendance was very low so we headed over to a car show held in Chick Filet accros the street. The lot was full of great cars, Cobras, 68 Camaraos etc. While we were there two state troopers pulled up and began circulating through the show complementing and enjoying it. Then we overheard one of them having a discussion with a car owner about how good it is that they come out and have shows and how much they don't like the import kids who have loud mufflers and stereos. All this was said standing 2 ft from a T Bucket with open headers that idles louder than my car at full throttle.

So after leaving there we eventually made our way over to Manassas BK and after a few a local cop pulls through the lot and yells out the window "Them lights are off that should tell you something" and he pulls off to watch that everyone leaves.

The dual standard is not what law enforcement is for and that should not be tolerated. But what had me boiling mad was the fact that this cop had no concept that what he was doing was unconstitutional. He is used to saying jump and the citizen says how high. Most of us had a BK product in hand, there was no alchohol/public drunkeness and all was peacefull. The BK management had not asked us to leave or alter our behavior in any way. This one cop who didn't want us there took it upon himself to tell everyone to leave.

This sort of foolishness is exactly what the authors of the constitution and bill of rights had in mind when they wrote these documents. An example that my constitutional law professor gave was that a man can walk down the street at 2:00am and be free from being searched or questioned by the state. Furthermore the right to assemble peacably was penned with a few things in mind. Events such as a labor union gathering and a religious event could poceed without threat of being closed as well as so that citizens could gather, on foot, on horse, or in cars, without having to disband at the will of the government.

The painfull part is this: Should this BK group recognize it's rights and refuse to leave, assuming BK management has no problem with them staying, arrests would be made. The officer would state that they were disturbing the peace. You would have to fight it in court. The local judge would just rule against you, what are you going to do about it? You could appeal, try to go to the supreme court, but your case getting heard there is like pleading to the king, you may or may not get an audience.

What they rely on is that kids will just comply because an arrest, even an unlawful one, would not sit well with parents, and that adults are more worried about being at work on Monday rather than in jail and that paying the mortgage is more important that paying a lawyer to "buy" ones rights.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Wow, a very moving agrument Scott!
Last night I went up with some friends, and we wanted to eat at Buger King, but we could'nt find a parking space in their small lot because there was a "classic car show" in the other big parking lot near B.K. You could'nt park in that area, and the B.K lot was full of people wanting to watch the car show, not people who wanted to eat at B.K. I saw almost no one who was parked in the B.K. lot actaully eating B.K food. The cops also parked in a few of the spaces, and tried to give a few of us tickets for parking along the edge of the grass. We parked on unmarked pavement, and it did'nt say no parking, the spot did not block and traffic movement either. So we are in line in burger king, when a nice young woman runs inside and shouts "the pigs are trying to give the imports parking tickets, if you have a import, you better move it".... I thanked her and ran outside... I turned on my car and waited 5minutes until someone from the car show left. then went back inside. shortly after eating we decided to just leave, and go to Expo... RICE FEST.... we stuck around for a while, but the girls who were with me had to be home by midnight.... I went home shortly there-after...

I really feel like writing a long essay to the local governments regarding this issue, and I know Scott, you could be a major factor, as you are older and wiser than I.

seriously though... familiarity with local laws is the only way to combat this kind of problem. I wold suggest to you all, to go to the local courts building or library, and look up the current ordinances regarding these types of issues. copy a few sections down..( 48.2 - 1 para 8....etc etc.) and have them on hand to recite to the officer. But remember to use respect and avoid embarassment if possible ( unless you know unequivically that you are right) and if he does not comply, get his unit number, and name. then call his watch commander or section chief.

Better yet.... get a WHOLE bunch of people to call.... with their parents... it stops when the people wish it to stop.

brian , i was happy to see you guys pull in and was looking forward to talking with you about your recent turbo install, unfortunately our time there was short and we left at the request of the local police[ i was in fear of being ticketed for not having my wheelchair parked in a space] i know that the import and late model scene picks up about 10 p.m. and was looking forward to seeing a few friends. i guess we will see how good business does for the B.K. after all the auto enthusiasts stop coming around. on a side note i saw the first S.V.T. Focus ive ever seen in the lot at B.K. last night.

Iwent up there last week early like 6:30 or so and noticed how many cops were there. They were writing tickets for everything they could think of even some stuf that wasn't a problem. I left after 15 min or so, slowly of course, cause i didn't want to be hastled like the rest. I think these a holes need to find something better to do with their time like fight crime or eat doughnuts or something other than bother people trying to have a good time. Most of the people go there to show off there cars and see some other peoples nice rides I don't think it's fair to pick on the younger crowd just cause "they look like trouble". I've been kind of tired of these Manassas police ever since they shut down the strip a few years ago. cmon we need some place to go w/o a pig hanging over your shoulder waiting for you to spit the wrong way. Thanks for letting me rant-James
