Default phase 2 2.2 into phase 1 2.2

Ok so I got a 95 Legacy auto sedan that I got for free good tranny in it but no engine it had a phase 1 2.2 w/EGR in it I removed it for the guy and put it in his outback. I recently purchaced a 99 impreza manual wagon with a phase 2 2.2 w/o EGR. I plan on doing an usdmEj20 swap to the wagon so I will have a good 2.2 also I have a complet phase 1 intake manifold with harness. My problem is the phase 2 engine has no EGR port on the head on the driverside. Ive been going over the repair manuals on STIS and for all of the EGR faults none of the troubleshooting steps ask to check if the pipe from the head to the valve to see if its leaking, only if its clogged. Could I leave the pipe off and not throw a cel. I have a bunch of exp working at a subie dealer for the past 7yrs but we dont deal awhole lot with N/A older swaps, plenty of Ej20 swaps. So please help a brotha out all advise is apreciated
