Dealer: Import Cars of West Chester won't honor sale!!!

Last week 12/09/11 i put an offer in for a 2005 Audi S4 to a dealership in West Chester, PA. A couple hours later i was responded by them with a counter offer of the same exact offer i gave them, $12,500. I simply accepted their offer and won the car. I called up the dealership trying to put my down payment on the car and they refused to take it and said they will not be selling the car to me.

Iv'e called ebay about the situation and they told me even though they can't make the seller sell the car, there will be consequences.

As far as me being able to get this car for the price of $12,500, what grounds do i have? Iv'e read over all of the other problems like this on ebay but my situation is a little different.

I really hope they just do the right thing and honor the sale, i have contacted lawyers. I dont want to go that route but if i have to i will.

Don't waste your time.. your lawyer won't be able to do anything but worth a shot.

They would have to sue eBay, you can't sue them.

Been there done that, car dealers pull this crap all the time. Unless you're willing to hire a lawyer, all you can do is leave them bad feedback per ebay's rules. ebay sucks

Why wouldnt my lawyer be able to do anything, and what grounds do i have as to suing ebay? According to other people i was told its a binding contract, especially since we agreed on a FIXED price of $12,500.00.

Agreed ebay does suck, they weren't willing to do anything with this at all. Told me to leave negative feedback file a claim. Thats it.

Suing the dealership would mean getting eBay involved since eBay provided the service.

And that is not going to happen. You will end up spending more than you would have paid for that car.

The service was provided by eBay, you will have to get them involved and their lawyers will pull up the TOS and done.

You really think your the first person to have had this happened to? nope.

The GTR, Dodge Challenger, Hyndai Genisis Coupe, BMW M3, Bentley cases all were won. Some went to court most of them didnt.

Alright go to court, you will spend the same amount of money you would have had paid for the car.
