Not only this, but he does not have evidence to support that you were the driver that day.

Anyway just plead insanity.

I had a meeting with a PI about this guy and it was very interesting. This is not the first time this PI has been asked to look into this guy. He tells me that he is very shady and has sued his brother, parents, and several other victims total of 10 cases.

The PI told me its not worth my money to hire him unless it goes to trial, witch it probably will not. The PI was very nice and did not charge me for the information he gave me. He suggested that I get a good lawyer due to this guys persistence and addiction to sue. He recommended me to a highly reputable lawyer that is an expert in these types of cases.

The meeting with the PI went well I'm just a little stressed due to the nature of this guy.
Now to schedule a meeting with this lawyer.

I hope this litigious dirt bag doesn't have a smoking gun of a lie and what ever he claims I can back up with the truth.

I won't know what I'm up against until the Feb 7th.

I am not going to release any information about this guy until it is settled, when that happens we can have a nice long thread about this guy.

You may want to refrain from saying such things as "yada yada yada." This can be construed as assault.

do you have full coverage? if so you really need to call your insurance company. since you were in your car it is their problem and they will get one of their lawyers involved. no sense in paying for a lawyer out of your pocket when you pay for insurance.

I think you're going to be okay, like I said he has the burden of proof. I can't imagine that this guy has much of case a year later. It just doesn't make any sense why if he was injuried he wouldn't have got your insurance information or heard anything during this entire time.

But a year later? Really, this guy is just wasting your time. I'm sure you will be fine.

This is probably what he did, after talking to the PI it sounds like hes always on the hunt for a new lawsuit.

You guys need to straighten up and think a little bit.

#1- Close this thread and try to have it removed. You don't want this or anything else like this hanging around.

#2- Call the insurance company, and see what they have to say. Since it did happen in your car, they need to be notified. I would still urge you to get your own lawyer.

#3- He is not okay, and he better have a good lawyer. The guy is obviously a crook, and a smart enough one to wait and file suit after any and all proof of liability has been destroyed. It will come down to your word versus his, and they may side with the "victim".

I know, I've read the thread too. Asking a car forum is not the right media. A legal consultation would be a better idea.

Nothing against you personally Whattheo, but if this guy's sue happy he's probably pretty good at it, or else he wouldn't have the money/motivation to keep hiring lawyers.

I had a meeting with my lawyer, and in our discussion I mentioned this thread he is aware of it and finds nothing in it that can be damaging to my case. I just need to be careful about the content. I'm not going to release anymore in depth information pertaining to the events at hand.

As of now we feel like we have 100% chance of winning. I won't know what this guy is up to until my preliminary hearing.
I can tell you that he is representing himself and he is a personal injury layer.

At this point we can discuss in general but, not in much detail.

I will keep you guys up to date about what is happening. I will only be vague about the information given until it is a closed case. Until then, if I win I will disclose more information in detail.

Thanks for everyone's thoughts.

Can't the judge look into this guys history and see that hes had 10 ( as the PI says) cases of suing people and just tell him to get lost.

Bringing up a lawsuit should be a once in a lifetime event. If its happening repeatedly, you are either dumb and should be removed from the gene pool, or you are making false claims and wasting time and resources, and should also be removed from the gene pool.

I work with law enforcement... with his history the judge will be pissed hes in the court room and dismiss his claim. Counter sue for lawyer fees. you will win.

Getting all my ducks in a row, have my hearing tomorrow. I don't see this guy having any evidence and the case should be dismissed. I guess I'll find out what I'm up against, I am counter suing.

Yesterday was my court day, and this guy didn't even show up! Turns out he was arrested in a different county earlier that morning. I don't know what he did, but my court date has been postponed to 2/22/2012. My lawyer tried to plead our case but the judge wouldn't here it without representation from both parties.

I just found out that he was arrested for DUI and it is not his first.

If he really is a lawyer and this is a second DUI he mostly likely will be disbarred. Guy sounds like the ultimate tool.
