Default Need some advise! Bad experience with a shop! Nightmotorsports

So I first heard about this company Nightmotorsports LLC through the online Subaru forums. I seen that it was a new shop and the shop owner was friendly via messages on Facebook. Nightmotorsports posted a deal where it includes a package of engine internals. So the first thing I did, is I messages him due to my car needing a rebuild on the engine. He stated that if I wanted the package it'll be $3200. So, due to that fitting my budget I took my car into Nightmotorsports and I felt really comfortable leaving my car there as his pitch made me feel as my car was going to be in good hands and taken care of for that price.

That same day I left a deposit of $1000 on 10/4/14. He stated in order to see what's the issue on the engine, we would first need to take the engine apart. He stated he will do that in about a week. I said ok. I went a week after to see if anything has been done with the car, he stated that he's been pretty busy and has one car in front of me. I said ok I understand and did another deposit of $1000 on 10/17/2014. I then feel that i won't be able to pay him in full before 11/1/14 so I advise him to schedule himself finishing the car by 11/15/14 due to that being my payday. I then receive a call from him advising me that he found some melted wires underneath the dashboard. In order to make the cluster work properly, he would need to replace them. He said he has a electrician that can come and have it replaced, I then tell him I really can't afford any further expensive work. He then said it's ok I'll do it myself and save you some funds. I said ok but only if it's cheap replace it. I then get frustrated on 11/5/14 due to me feeling like nothing has been done with my car. He says the wiring "will be compete , I just need to do the engine work" on 11/5/14. I said ok I'll have the rest of the funds which is $1200 by 11/15/14 so I was hoping my car will be done before thanksgiving. I send him a message on 11/6/14 advising him if he could show me a picture or some type of proof that I had a melted wire, he stated it went with the trash this morning. I then head out to the shop to see what going on with my car on 11/15/14 and my car was parked outside and it had a big scratch on my drivers side door. I then call Stevan to see where he was at as the shop was closed but the shops hours states he is open on Saturday.

So he arrives and I sit down to talk about my car with Stevan. He looked a little disturbed as his Shop car had caught on fire the day before. He then states right now we are even.i deposited another 1000 on 11/15/14. I was confused as what he meant by that. He stated that the $2000 that I had deposited for my engine build went to the labor and part to fix the bad wiring underneath the dashboard. So I'm still confused. He stated that 1250 was for the part, and 750 was for the labor. He stated if I wanted to get started on my engine build, it'll be $3200 plus $2000 labor to start working on my car which would total to 7200 spent! I then just felt robbed as the funds going to my engine built went to some overprice simple wiring. He then stated to finish my car it'll take another month. So I was really upset. I then leave and tell him that I am going to cancel the rebuild. He then allowed me to pick up my car that day. He refunded 1000 that I deposited that exact day. I then tell him about he damages on my car and tell him my car was just painted a month ago. He stated " your car has always been in the shop, today was the only day it was outside". He then walks back in the shop.

I felt scammed. I then send him a message with pictures of my car when I dropped it off as proof that the door damage was never there. He stated we will accept the fault and will paint it but you have to bring it to our shop. I then said ok. I felt really scammed about the wiring being replaced as he never kept the original part and as he doesn't want to provide me a receipt of the part. So I take it to a local shop to have professionals take the dashboard apart to locate the brand new wiring that cost me 2000 in total including labor. Everything was still dusty underneath as if nothing was done. I just want my $2000 back as nothing was done to my car. I paid with my debit card.

What would the Subaru community advise me to do!

***Update 11/28 I was advised that the ECU was never replaced.

After I gave him a call today, he didn't want to refund the 2000 or provide me with a receipt of the part that was replaced. I told him that I will take this to small claim court and he said If I did, he will report my car to the DMV/police about the "illegal" mods I had on my car.

Get a lawyer. That's about the extent of what you'll be able to accomplish now.

You're probably screwed if you don't have his original quote of $3200 in writing.

I don't have it in writing but I have it in a Facebook message as that's what we would talk about my car and how I met him

He also threw away the melted wiring without my authorization and never have me a price on it, he just said I'll take care of it. I keep asking him to send me a copy of the part or the part number that he replaced but he avoids the question.

Wow. When something like this happens it's easy to say "you should have". Your best bet to move forward is to collect all your documentation, statements, conversations, receipts, etc and hire a lawyer. If you have a statement by a certified mechanic saying that no wiring has been replaced and proof that he is denying you a receipt for service then it will benefit you. Keep dates and proof of the event on each date the best you can to fortify your case. He can always say that he never talked about labor during your initial consultation especially if there is no indication you discussed it. You might be boned on that.

Bottom line is I would ask for a consultation from a lawyer. You'll probably have to spend at least some for a consultation though.

I really appreciate all your thoughts on this but I never signed a estimate authorizing the wiring , he says he does not have to provide me a receipt of the part number as it is confidential. I told him I would subpoena a copy of that receipt and he said he does not have to provide either way. His shop has only been open for a couple months so I'm pretty sure he's not aware of the law

Is this the place in wonderful Bloomington? If so, its simple. If there's no authorization signed for work, there was no approval for work to be done and he is screwed. In addition if you specified any parts returned they need to be retained, till you get em. Report his shady ass to the BAR and file a complaint. I hate ass shops like these guys making everyone look bad after being in the field as a leadtech for 15 yrs before moving on. Believe me, last thing any CA shop wants is the BAR on their ass.

Take him to court. I doubt the cops can do anything as they didn't catch you driving the vehicle. Further more, you can site him as performing illegal modification to vehicles that are being used on public roads. Chances are he is trying to call your bluff.

Take him to court, get your money back plus some to cover lawyer fees and time loss.

I would call him back and ask for the part number directly. Limit the conversation to just the question. Don't give him a chance to dodge. If he doesn't comply...

I would hold him in public court. Ask for your part number on his Facebook page. Send him a link to this forum post and ask him to respond.

If he is honest and didn't steal from you it will be over quick because he will provide the requested documentation.

If he stole from you then he is stealing from others as well and should be held accountable.

Also, I wouldn't allow him the opportunity to make it "right". If he is pulling this shady ****, chances are you will get a half assed built motor that will pop within a very short period of time, and there will be nothing you can do to prove it was his build quality.

Take him to court, get your money and car back and take it somewhere reputable. Don't bargain shop when it comes to building a motor. Simple things like an exhaust, sure.

This is my first time taking it to a shop and yes I made a bad decision. I should have saved my money and took it to a more reputable shop. He wants me to take it to a shop to fix the damage on the door and I'm guess his tactic is to replace the wire while he has the car so he can technically said he did something

Nah he just wants one of his back alley friends to fix it on the "cheap". Which means Ghetto Paint.

Some people should not open their own shops.... Call your bank and see what they say.

Of course he won't give you his invoice. Get your own invoice and the part number of what he replaced. You should be able to tell what it is or if it even exist.
