Anyways there is your problem, a 2009 Legacy key remote unit has a black backing. The white backing with that FCCID indicates it is a 2010 Legacy key. So that is why it didn't work.

Further compounding the whole thing is that key shell is for the 2011+ Legacy. Looks like someone was swapping key parts around...
ok so i just read thru the thread, my key has the white housing inside, so it would be a 2010 key?

Correct. The FCC ID ...766 white is a 2010, black is 09, same FCC ID. The FCC ID on a 2011 is ...811.

You can probably sell it. I'm sure there are some guys on here who don't want to hassle with eBay trying to find a key and the 2010 does have the least expensive ECM for the 08-10 guys like me. I had two keys and two ECMs before I finally got mine right dealing with eBay.

Why not send it back to the eBayer? It doesn't 'technically' work.

Been a while since I bought it. Not sure if they would still accept it as a return.

I think most/all sellers have to accept returns within 14 days. If you're buying off eBay you should check out your key right away. If it's not the right one, send it back!

I came over here to check on any key swapping technical issues but y'all have got it figured out now you don't need me anymore. Do be careful of those "new blade" keys you don't know what is inside. The prices aren't all that bad for new ones from Subaru.

Oh that is interesting! You had the seperate keyless module, with just the 8 pin plug? Wow '11 is supposed to have a new combined TPMS/keyless unit totally different unit and frequency strange you had leftover '10 stuff.

I didn't order a key there, I ordered the 2010 legacy ECM. I am not sure if they sell keys there... I got my key the old-fashioned way... eBay.

Got mine finished! Programming was a lot easier then it looks on paper. I got it the first time. Like previously said just print out and bring them with you out to the car and it makes it pretty simple. Thanks xluben for the idea/shell and b1aze for the legacy key!

I have noticed that the 09 Legacy keyless module and flip key communication seems to be hit and miss whenever I press a button. Sometimes the car will lock/unlock and sometimes it won't with the same pressure on the button. It is not like the original key fob that works every time. Any thoughts?

Is it seated into the housing correctly? My Legacy remote (in the flip shell) is much, much more responsive than the stock teardrop remote was (1.5 years old).

Agreed. And I also think the leggy transmitter has a longer range than the teardrop.

Yeah, seems like 2-3x as much range.

Yeah, I was stumped at first too... I programmed it 4 times and pushed one of the tear drop remotes out of memory so I was definitely programming it correctly.

I checked the FCC ID on the remote (which I should've done first) and realized that it was the one that interfaced with the 2010 Impreza ECM - NHVWB1U711. But all's well now thanks to your how-to on replacing the ECM.

went ahead and contacted the seller, a couple of choice words and the fact that I hadn't left feedback yet got me a pretty quick response. They will be calling me tomorrow.

If they didn't lie in the listing and you waited this long, you should just suck it up and keep it or resell it. It's really your fault you didn't open it up when you got it. I hate seeing people abuse the eBay system like that.

The listing was for a 2011 key, I did not receive a 2011 key how am I abusing the system? THE LISTING EXPLICITLY SAID 2011-2012 SUBARU LEGACY KEY.

The 2012 Legacy key is different. If you want to pursue it, I'm not going to stop you. I just think that it's the buyer's responsibility to deal with issues like this within a timely manner.
