Default Help!! Warranty crisis!!

i have a huge issue. i bought a 2011 wrx including full drivetrain warranty about 2 months ago and about 2 days ago i felt my clutch was slipping, feeling stiffer than usual, and engaging higher as well. I brought it to the dealer, they took the tranny apart and discovered that the full clutch assembly was an ATC aftermarket clutch and are now denying my warranty. What do i do?!?!

If it came with a warranty and had the clutch in there when you bought it with the warratny, then they have to grant you the warranty..

Unless he bought from a private party. His drivetrain warranty is still valid, but it won't cover a aftermarket clutch.

Is the dealer that sold it the same as the dealer that found the ACT clutch? How many miles on it? Is it the balance of the original warranty or did they give you an additional warranty?

No it was a different dealer by my job i had it checked out while i was working and it had 19k miles when i bought it and now it has 24k and its the original warranty up to 6 years or 60k miles which ever comes first

Take it to the dealer you purchased it from. They are responsible for it.

Chances are the selling dealer had no idea the clutch was aftermarket. It is not like they rip the transmission apart when doing the used car check. BTW, clutches are covered 3/36k not 5/60k

I'd be curious to what the cars history report shows. It showed an exhaust one of my brothers did on a Challenger. But I guess that wouldn't matter since a dealer prob. wouldn't look at that for every used car sale?

you and me both. seeing how the OP said the car has only 24k and the clutch was replaced. i bet there was a DP and tune on it, was beat to hell, and traded back in. while i hope thats not the OPs case, im sure it is. as for the warantee work, take it back to the dealer you bought it from and make them fix it, apparently no one knew there was an aftermarket clutch in there..

I would also get with the dealer and get the warranty history of the vehicle. The clutch is covered for 3/36, like mentioned above, so why was there an aftermarket clutch in there? If it was done under warranty, then it should be a Subaru clutch, not aftermarket. If it was done aftermarket, there was a reason: Either the original owner didnt know that a clutch was covered, or the car was modified and the clutch was denied under warranty and the owner went somewhere else to have it done.

Also, they are not denying or voiding your warranty, they are denying the claim, which they should, although it is not your fault.

Another option would be to see if you can find out who installed the clutch (although a long shot, a Carfax might show it with some detective work) and see if they offer any warranty on the clutch.

I was under the impression that a clutch is considered a wear item and not covered under warrenty, unless the clutch was manufactured defective. If it's just worn out then I don't see why it should be covered, OEM or not.

Clutch isnt wear and tear and even if it was im at 24k and its good for 3/36k

yes it is. your clutch isn't covered for your entire powertrain warranty.
