Default warranty help?

Hey guys so I need help..I was driving down 29S today cruising on 5tth gear at roughly 60-65 miles an hour...I hit the gas a little, and all of a sudden the RPM jumped from like 3 to 6k. I tried downshifting to see if it would do the same thing..It did and it would always rev super high..almost to red line and i would hear the turbo spooling but no power. And all of a sudden my car started smoking..I smelt the burning clutch..but i didn't have the clutch depressed at all. I was in 5th gear and cruising! Anyways I was able to get my car to the side of the road and I had my car towed to the Herb Gordon subaru. I know it's a blown clutch because I can put the car in first and just release the clutch while it's in gear without it stalling..
I really don't know why this would happen. I don't drive wrecklessly..nor do I race people a lot. Of course sometimes, i'll have some fun with it..but never anything dangerous..And also if it helps, i purchased the car used with 15k from a dealership. clean autocheck. and it now has 26k miles on it (2011 WB WRB WRX)

Anyways long story short..i'm still under some 3yr/ 36 mile warranty with subaru. Would this qualify for some sort of coverage..I don't understand how a clutch could get so messed up in such a short amount of time..And if it's not covered would it be cheaper to go to the dealership to get new clutch or just get a friend to install a nice aftermarket clutch

With only 26k on the clock, heck yea it should be covered. Don't take no for an answer. You should even get a spare care while yours is in the shop.

If your clutch is OEM, then you should be covered by the 36k mile/3-year warranty.

The hill holder failed in my car at around 26k miles one morning as I was leaving work. I couldn't get the car in gear or move, even though I was on level ground. Warranty covered the cost of labor of dropping my transmission, opening the gearbox, replacing the clutch and brakes. For the 3 days my Forester was at Annapolis Subaru, I got a rental.

You should be fine and taken care of at Herb Gordon.

Annapolis Subaru replaced my whole clutch assembly for a bad throw out bearing at 28k miles. I was kind of surprised but yea you should be good.

I was hoping that you guys would say this...I've been losing sleep. freaking woke up at 6.30 stressed out over this. I don't know if it's OEM...i mean I purchased the vehicle used. I'm going to go there this morning and speak with them. And I wanted to go to Annapolis, but they're so far..and I just brought the car in for service last week because the rotors were warped and my friend said the calibers were jacked up. They said they replaced the brake rotors and pads for free under warranty..but what kind of warranty covers wear and tear?

Subaru states on their own site that it's covered.

https://www.subaru.com/my-subaru/warranties-2013.html

Quote:
WEAR ITEM COVERAGE is 3 years or 36,000 miles, whichever comes first. Items covered are brake pad/shoe linings, clutch linings, and wiper blades.

Wow..thanks so much for the help guys..it's still in the shop. they said they're really backed up and haven't got to the car yet. you all have been so helpful..but they also mentioned that they're going to check for signs of abusive driving. I haven't abused the car..I'm just worried that the original owner might have..

Good luck with that. They'll have to prove it was abused

Hope it works out. I know a lot of dealers(different makes, not just Subaru) try to claim 12/12 on wear items. And it can vary depending on the individual shop.

A clutch is covered by the wear item 3/36k warranty for NORMAL wear. If your clutch/pressure plate has signs of abuse(friction material and the pressure plate is blue) then the warranty does not pay for that. Keep in mind there is no way to know this until the transmission is removed and you may have to authorize the diagnosis/check and be responsible if it is not covered.

They asked me to authorize the diagnostic. and I said yes. I wasn't too worried because I don't abuse the car. but again I bought it used..so i'm still a little scared..

I read that twice and I'll hope for your sake it was a Subaru CPO car. Otherwise, I see a world of pain in your future.

Although, we could start a Kickstarter campaign to contribute to your beer fund to soften the blow.

Mine was covered.... I bought my car from a guy that figured out he couldn't afford it after 9 months. He had put 26k hard miles on it, I was really relieved that I didnt have to pay for it since I had it maybe a year and had only put 5k miles on it.

Yeah. of course I'd be lying if i said i bought a WRX without racing anyone. I mean i don't push it a lot. i think if i were to have ever raced anyone i push it to like 6 rpm. anyone that buys a sports car..no matter what they say push it to a certain extent..but even if i were to race it every day, i can't see how the clutch can go out that bad so quick..

and update..herb gordon just called me and they told me that it won't be covered under warranty because of abuse. they said they'd cover 50% of it. so they'd only charge me 600...but i think that's still ridiculous as i've only had the car for 7 months...i'm going to still try to fight it...but does anyone have any recommendations?

Realistically speaking, how much wear would a single clutch dump visibly put on the clutch and pressure plate? How many til it definitely looks like "yeah, this was abused" eh?

Sounds like a call to SOA is in your future.

Is the car stock? My clutch went at 27k but I was pushing a good bit more power than stock. I didn't even bother taking it to the dealer because I didn't want another OEM clutch that would just go again in a few months.

Can they prove to you it was abused?

You owning it for 7 months is not their problem, nor do they care. They just see a prematurely worn clutch and claiming it was abused.

When I had my stock clutch I dumped it at the track countless times. When I swapped it, it looked great for a car with 90k. No reason it should show signs of abuse unless the previous owner just sucked at driving lol

If they followed policy, they tore it down, sent pictures to their District Parts and Service Manager(SOA Rep) who made the call that it was abuse and offered the goodwill.

Yes, you may have owned it for 7 months, but it is not a brand new vehicle and the previous owner could have abused it.

Yup, I would take them up on the deal. But I'd want to see the evidence myself. Just the clutch being worn early is not evidence of abuse. I'd be looking for heat discoloration or cracking on the flywheel and pressure plate.

So they replaced the warranty, and I ultimately had to pay 600...the pressure plate flywheel throwout bearing and clutch were all jacked up...it looks like it's been driven over 100k miles..I really don't know how I could have done something like this in 10k miles...I'm pretty much paying for the previous owners joy rides

Edit: because I forgot to include the pictures of the parts.

terrible..

The disc looks pretty melted and I see some dark spots on the flywheel, but no discoloration. Looks like someone was doing a lot of launches at some point
